Heart breaking case all around, but hard to see the jury having any other choice...

If a young man had stumbled into a cops apartment believing it to be his own and then shot and killed that officer believing them to be an intruder, no one would care what he "believed"...

I am surprised the prosecutor went with murder over manslaughter and I'm wondering if it will be reduced on appeal... Is that a thing that happens, murder conviction reduced to manslaughter in conviction?

Funny. I can tell you 100% that every time I've used that term it is ironically. I am mocking the group that uses it (ie, some of the people you frequently agree with). It's amazing what sort of things fly over your head.

The first was clarification on the legal definition of manslaughter...

The second was clarification of the castle doctrine...

The castle doctrine, they probably saw clearly did not apply despite the defendant believing it to have been her castle...

I'm curious what they saw in the manslaughter definition that made them decide murder...

I'm curious.... the jury doesn't have the ability to select murder or manslaughter do they? I thought that is solely up to the prosecutor and they decide if it fits?

Opel, I think the judge could have cast aside the verdict, but not changed it. Also, I think a verdict can only be reopened if appropriate new evidence is found.

According to cnn they had the option... I'm guessing she was charged with both perhaps in case the murder charge didn't stick...

Well, 1st degree murder requires malice and forethought that I just don't see here. It requires the intent to hurt or kill from the outset.

Manslaughter requires something like reckless disregard for the safety of others.

Ah, I looked it up. You're correct. They apparently charge both (with the manslaughter as a "lesser included offense") and allow the jury to pick

This is a sad case all the way around one dead and the other's life ruined. She should be doing something like 15 years for manslaughter. IMO.

Wonder whether there was ever an offer made by the state and if so, whether she rejected it or what her counter offer was...

More than likely the judge will reduce charges and sentence, if anything less than murder was found then civil unrest would unfold with riots, looting, and cop shootings.

We all get judged for our bad judgement. It is a sad situation.
Cops are heroes because they are disciplined enough to not shoot until it is the last resort. That’s why they get privileges the rest of us don't. That’s also why they get the benefit of the doubt and many passes by the courts.
She had a bulletproof vest and a gun in her hands.
She shot a guy who put down his ice cream and jumped up off the couch.
For Pete’s sake, does a badge cover every shi**y decision a cop makes? The guy was in his own house for fuq sake.

That’s typically the case or, in some jurisdictions, defendant can be convicted of a lesser offense. I worked a very high profile case where the state wanted 1st degree murder and the jury convicted of involuntary manslaughter with a recommendation of zero jail time (apart from time served).

If I recall didn’t she mandatorily have to work some ungodly amount of hours straight. Fatigue will mess with the brain ask any resident at a hospital. The impairment is similar to a drunken person, when they are in an accident and kill someone they are not charged with murder.

There has to be more to this deal than has been published for her to get murder. Murder requires intent and/or pre-meditation. She was definitely guilty of manslaughter, no doubt of that. So the timeline must be such that she actually had time to ponder and opted to shoot. That's all I can figure. Unless the jury has just had enough. That's possible too.

But if the day ever comes that an American is not safe in their own house, and/or there is no recourse for the acts of civil authority, it's the end of the republic. Cursing

First, do we know if it was (as it is called in many jurisdictions) 1st or 2nd degree murder? Both are murder, with 1st degree being premeditated.

Second, prosecutors can be weird, especially if it is election time. There was a case in Baltimore where two brothers owned an auto repair shop that was repeatedly burglarized. They decided to sleep in the shop in case it happened again. It did and they confronted the ARMED burglar and it ended up with the bros shooting and killing the burglar. They were charged with premeditated murder, because the prosecutor argued that they ‘laid in wait’ to execute the burglar.
