Since the Senate wants to recess early (12/09/2016), would this allow Obama to make a recess appointment and would Ryan and McConnell be that dumb to take the chance?

sort of an indirect response (ok, not a response at all to your question) but I can't help but wonder what if Obama's nominee had been a great candidate, admired by both parties?
On the surface it sounded like that may have been the case. America held hostage!

Sorry zito, hijack off.

is such an action possibly allowed? Seems dubious, I'd say procedures in place must be followed.

Executive Orders are HARDLY
"Possibly allowed actions"...
They bypass everything the constitution
Stands for...
The O.P. Could be a last "F.U." up the AZZ to congress.

Should be allowed if congress fails to act on an appointment.

Totally agree. I had heard from some that the SC picks were THE reason why they weren't voting for the Clinton Crime Syndicate.

Don't know that it should be allowed, but Congress should be ashamed of itself.

we are radically different, yet we both want new choices, and that is our common ground. keep doing what you do.

I voted Sanders and Libertarian in that order.

Happy Thanksgiving to you and yours J.

Garland isn't an animal?

Sorry did I miss out on overreaction outrage?

Stupid congreys doing the same thing others have done, but now it's more baderer than tat other time cuz that was "my" side?

GMAMFB.

Garland was a last ditch effort for Soetoro to get one last brick on that wall before sister sledge got denied again. Is Garland MORE moderate than the POS Barry already got on who shouldn't have made it? Oh for sure.

Now the democRATS will demand that all King Cheeto's appointments be R versions. Just wait, I'm never wrong.

It's interesting how the Dems are crying foul. For years they have been the party of identity politics. Instead of debating issues they throw around racism and other inflammatory words to attempt to divide and conquer. Obama was elected largely to be the first black president. Hillary ran as the first women president. With the exception of sanctuary cities and most of New England voters from coast to coast voted Republican.

But, the pendulum has swung in the opposite direction. Republicans now control the policy making branches of the Federal Government and somewhere around 2/3rds of all the state governments. Democrats piled on Trump because he didn't directly say he would accept the results of the election. Yet, now members of the left are asking Hillary to contest the results because they claim the election machines were hacked in a few swing states.

Dems have gone on record claiming the Trump transition is in disarray. But, he's announced his cabinet picks at a much faster rate than the last 3 presidents. They say he's against women, but he's announced females will fill at least 2 high profile posts. One idiot was on CNN claiming that Trump was turning the transition process into a reality show because instead of meeting potential appointees in private they were streaming in and out of his transition offices. Trump has met with his detractors from both sides of the aisle.

I underestimated the level of pent up partisan frustration and how that impacts folks view of the world.
