Tax on my order? This is new...

I was just charged Sales Tax for the first time on an order here with CigarBid. I have been a customer for years, buying regularly. I scoured the site to see what changed without luck. Anyone else experiencing this? I am not in PA or any state that has a Brick & Mortar for these folks. Any help is appreciated.

Yes, I already sent a request in, but it always take a little time to hear back.

Are you in Texas?

CI opened a B&M in Dallas.... And so.... All Texas residents get to pay the piper now. 7.5% added to the cost. Will need to watch prices more closely.

Meant the OP. It would explain the tax. It must have just been implemented as a CI order I made from a couple of weeks ago wasn't taxed.

Sucky part is that the order still ships from PA.... But still have to pay the tax it seems.

The extra tax has nothing to do with your low post count.

Yes, Illinois. Without a B&M in Illinois, charging out of state Tax is illegal (federal crime) unless the laws have changed. This would subject them to audit and fines unless all that tax goes to the Fed. By giving certain members a pass it would appear to me that they are simply pocketing it. If this was merely a marketing idea to get more people to go Platinum it is a legal pitfall.

BTW, I did finally find the info I was looking for under the terms and conditions. This is NEW. It started the beginning of Oct. and applies to certain states:

Indiana passed a new law that retailers that have over a certain amount of sales in the state collect the taxes. If I remember right the b&m stipulation was overturned maybe at the federal level. Lost revenue and unfair competition for physical locations in the state were the reasons the news gave. I guess many other states wrote similar legislation and I bet the rest will quickly follow.

So there you have it. I suggest checking Terms and Conditions to see if they have changed before placing any bid. By the way it looks they can put anything in there (like a $500.00 service fee) and you will be stuck when they bill your credit card.

You weren't paying attention, the law changed regarding state taxes and the physical presence standard.

Nightmare for sure for smaller ecommerce businesses. You either now have to keep up with all the states laws or subscribe to a third party tax calculating service.

That is correct, I wasn't paying attention. That is why I would hope that sellers would bring it to their customers attention before it's a surprise credit card charge. Not required to do so, but just the nice thing to do.

We figure our own state taxes. This throws a wrench in it, specially since they are only collecting state and county (not city) so now I have to figure another 1.25% and send to the state on top of this. Multi % throws everything off. 8.25% across the board for ALL out of state purchases is much easier from a personal financial standpoint.

There is no such thing as a platinum membership. If you live in a state that is affected, no one is exempt....

We don't make the laws in your state, we just abide by them.

Ya, good luck with that, lol. California and New York are still trying to figure out the best way to maximize the screwing their residents, that's the only reason they're not on the list.

Pretty sure they would have something to say about a standard cross boarder rate... they will want theirs to be higher no matter what the flat rate would be...

So not going to happen.

They choose, rightly or wrongly, how they wish to comply. The other major auction site I use has not made this change. So... My bids here are now reduced accordingly and CB is now at a 7.5% disadvantage right off the bat, plus usually a small shipping disadvantage based on my order size.

Seriously... $250 for a cab of PLPC. That's $5 each. You name me ANY cigar you can get here for $5 (including the tax and shipping because I don't pay tax or shipping) that's better for that price.

Hell, by the box, most Havanas are around $7-10 each.

Why would sellers have to remind you of the state laws that you live in? Should they have the Declaration of Independence in their terms and conditions?
