So there has been a young women on the news who left America to join ISIS a few years ago. Now she is in a refugee camp and is begging to come home. Trump and the government have said no. I agree. When she chose to be our enemy she became our enemy. She does not deserve a mulligan.

IDK....she tweeted some pretty subversive stuff....aiding and abetting and all that....If we just revoke her citizenship and cut her loose, she's free to continue to radicalize and terrorize from wherever. Ideally, I think she should be arrested, brought here, tried and sentenced. I suspect that the underlying problem is that the feds risk not having enough evidence or confidence in a conviction....so, just set her adrift.

So I was with trumpenfeurher on this at first.
Then the woman pointed out that he's doing this without due process.

That means that any of us, based on association with any group our current president does not like (or future president) can be kept from returning to our country?

It's... Not great.
Government needs to act in a legal and procedural manner. There needs to be some sort of trial to assess the level of her association, as well as establish whether association with a terrorist group is a crime which would allow citizenship to be stripped....

Can't wild west this shiat

Honestly, is that written into the constitution?
We are a nation of laws... Even if it's spelled out, all citizens are subject to a fair trial. What if her Twitter feed or whatever the hell she claimed she loved ISIS on was hacked? What if she was drugged or her children were held hostage...or whatever.

I'm not saying that I believe any of the above, but a trial is where an individual can defend themselves and their guilt be properly determined, then the appropriate punishment applied.

This is how our government is supposed to run.

Right, but no one is asking them to take the women back... And most places aren't because they can't be tried for anything... But they can be left behind to dodge mortars and pick grains of sand out of every crack and crevice at zero cost to their home country...

Don't know about most of them, but I think that Muthana (and others) could/should be tried. The ones that don't have much/any evidence of warring...I say let them back to the countries of origin.

I suspect that we're better off with them reintegrating instead of wandering the desert looking for another radical group to latch on to. Sure, there's probably a few that might even cause some trouble back in a Western country. Maybe I don't know enough about the typical woman we're talking about, but I have to think they're in the minority. I'm ok with some sort of 'probation' or years of some sort of 'monitoring'. But leaving them (and their kids) alone in the desert doesn't seem to make a lot of sense.

I don't think there's a legitimate fear of the women left behind in these places joining a new radical group... Thankfully, life is hard in the desert, and if you don't work hard at it everyday, you die... She'll be busy busy trying to live until she dies...

On the other hand, if we let her come home, easy times make soft people... She'll end up busying herself with spreading anti American sentiments and propaganda...

I'm not heartless on the matter... As soon as war breaks out in whatever patch of sand she's dwelling in, I'm all in favor of dropping crates of food and Superbowl t-shirts that predicted the wrong winner...

Judge denies expedited consideration in Hoda Muthana lawsuit

A request for a judge to consider the case of an Alabama ISIS bride’s citizenship on an emergency basis was denied in federal court today, attorneys said.

The woman, Hoda Muthana, left the United States to join ISIS in Syria in 2014. She’s been begging to return home with her young child, saying she regrets joining ISIS. On Feb 21, a lawsuit asking the court to recognize her citizenship was filed after the Trump administration said she has “no legal basis” to claim citizenship.

The judge’s denial means she won’t be able to immediately leave a refugee camp in Syria and fight her citizenship claim inside the U.S., AP reported. But Judge Reggie Walton did say the 24-year-old woman’s lawyer made a “valid argument” for her right to citizenship during a hearing Monday.

“The judge said the potential harms are too speculative. The judge said there’s no reason not to treat this as a normal case,” attorney John Eastman of the Center for Constitutional Jurisprudence told AL.com Monday.

The U.S. says Muthana is not a citizen because her father was a Yemeni diplomat at the time of her birth in New Jersey. Her lawyers argue he was no longer a diplomat at the time.

“Today we’re disappointed but understand the judge’s ruling . . . focusing on whether there’s immediate harm,” lead Muthana attorney Charles D. Swift of the Constitutional Law Center for Muslims in America told The Washington Post after the hearing. “In the meantime, we’re also very encouraged. The judge’s comments certainly foreshadow the ultimate outcome of this case in our viewpoint . . . the fact that Hoda Muthana is a United States citizen,” Swift said.

A ruling on the case could come this summer or fall.
