This is not a gift in the IRS sense. Usually, proceeds from a civil case like this one (tort defamation) are not taxable because it's not "earned income"or a taxable"gift". The government doesn't get a cut unless the award is for "punitive damages." Now, if there was some discreet income loss component for which full economic loss was paid there might be taxes theoretically, but I have never heard of the IRS ever doing anything like that.
