Congratulations Tennessee! Governor Bill Haslam has put your state in the national spotlight and, for once, it has nothing to do with Bonnaroo or how bad the Titans are. The republican executive of the state signed a ban on "distressing images" into law last week that we're sure constitutional lawyers are going to have a field day with. Anyone who sends or posts an image online (and yes, that includes TwitPics) that they "reasonably should know" would "cause emotional distress" could face several months in jail and thousands of dollars in fines. The best part? Anyone who stumbles across the image is a viable "victim" under the law and the government doesn't even have to prove any harmful intent. So, Tennessee residents who aren't cautious enough using Google image search could get a few people in trouble. Another, and perhaps more perturbing, part of the same bill also seeks to circumvent restrictions on obtaining private messages and information from social networking sites without a search warrant. We give it about a month before this gets struck down on obvious grounds that it's unconstitutional.

Can't seem to find too much about this bill, except for little one page articles, which for the most part are copies from another sites.

I checked the link Borndead provided, and found the following comment:

"the bill was written by a democrat. The only 8 votes against this bill were from republicans. Youre complaining about a guy who is the GOVERNOR who DIDNT WRITE OR PASS THE LAW."

Is this true? Does anyone know who actually wrote this thing? Did the governor have to sign this as it was veto proof? Is this an attempt by liberal bloggers and opinion rags to blame someone else for what was done by their own? Anyone actually have any FACTS on this one? Thanks.

Form a First Amendment/Freedom of Speech perspective, I don't care who is politicizing this. That's not the point worthy of discussion here, IMO, unless one solely wants to complain and throw mud about R's and D's; and/or so-called conservatives and liberals.

What is worthy of discussion here, IMO, is: the constitutionality of the law; if the law is constitutional, whether it will have a 'chilling effect", and/or if it is constitutional, whether it can be applied to those who otherwise have no connection with Tennessee.
