Judge Napolitano on What Would Happen If You Refused to Pay for ObamaCare

The IRS is gearing up for its new role as health care cop. The agency, whose main responsibility is to collect taxes, will soon be in charge of enforcing ObamaCare. How can the IRS police a bill that comes with no civil or criminal penalties for those who refuse to pay?

Judge Andrew Napolitano weighed in on the issue on today’s Fox and Friends, saying that if someone chooses to pass on the health care plan, the IRS can withhold tax refunds and put a tax lien on your house.
“Because Mrs. Pelosi and company wanted unanimity amongst the Democrats when the law was enacted and because of some conservative Democrats, interestingly some of them are not going to the Democratic National Convention this year, insisted that some tools be taken away from the IRS, some were. So, the IRS cannot seek an indictment, a criminal charge for those who willfully refuse to pay this. The IRS cannot seize bank accounts or dock wages. The IRS cannot add penalties for your failure to pay, the only thing that keeps adding is interest, and the interest is established by the statute.”

Napolitano said that the scary part about this law is that it provides for 16,000 new IRS agents and funds them for the first four years.

Lots of vacant commercial real estate, they can have a satellite office in every county. Of course they will need a car, computers the office will have to be totally handicap accessible. I don't think I could do that job. We've dealt with the IRS and other (state) agencies, and I think these people are trained to simply not give a phyuck. Go in, find something wrong if you can. and hit them with a big penalty. I mean, if a company or someone is doing something wrong, ok...I get it. Penalize them. And they are completely comfortable with doubling and tripling the amount you owe and adding interest on top of it. That's fair and reasonable, right? Of course, they (the government) come down on banks and cash-advance stores for the fees they charge becuase it's unfair/unreasonable. Sometimes I don't think the IRS gives 2shats if a company or individual goes bankrupt. They just love to assert their power...because they can.

291 agents in 2012. Unless they're planning on hiring 15,700 in the next 3 years, that's a bit different than 16000.

It explains EXACTLY the method by which the originator of that crappy number came up with the estimate, they based it off the estimated budget requirements the IRS gave congress, but they neglected a number of factors. Their faulty estimate was further conflated by idiots that didn't understand the method by which they made the estimate.

Hell, the personnel estimate was made off of the budget request, and you can ALREADY see idiots here then further inflating it by assuming that it will require additional infrastructure and non-agent personnel (if you'll read the link, that would already be built into the IRS budget estimate).

Huh? You're blaming me for a DIRECT quote from the IRS office?

You do realize that overhead on employees is significant, right? (rental of office space in DC???)
You do realize that there are probably significant software updates necessary to incorporate this healthcare bill, right?
A lot of data infrastructure that needs to be updated, which is likely paid out to contractors. Those 1269 FTEs are not likely doing that work. Accenture probably is, at $250 - $500 an hour.

Do I think it's inefficient? Yes. But that's not the argument. Less than 300 agents have actually been hired to handle the tax issue this year. Unless we're going to increase the number of tax-payers by 10-fold, the number of necessary agents is never going to reach anything close to 16000.

If someone wants to bitch that the IRS has spent almost 500million on the healthcare tax law, that's fine. That's an actual fact.

That's not what I said, nor is that what's in the quote.

Come on, this isn't rocket science.

There are only two facts we know:

1269 new employees were hired.
A total of 473 million is needed by the IRS in 2012 to handle the tax impact of the Healthcare act

Bitch about one or the other of these two facts, but don't try to turn them into something they aren't.

Let me walk you through this.


An agent is an employee.
An employee is not necessarily always an agent.

If there are 291 new agents, but 1269 total new employees, how many new employees are NOT agents?

Can you figure out the correct answer?

Nothing you have said has been right so far.

Follow the link to the 2012 IRS budget proposal if you want to actually see the correct answer and how it breaks down (I warn you, it is much more complicated than "Agents are employees, but not all employees are agents".)

All I ever f-ing ask for is for people to understand what is and what is not a f-ing fact. People are making up bad numbers and then basing their statements on even worse understanding of an already bad number. It just makes our entire population sound like f-ing morons.
