Being a member of the House of Representatives is not a constitutional requirement to be Speaker of the House. There hasn't been a point in history where the Speaker was not an elected House representative but there is nothing that prohibits it.

I think it's too bad the speaker role has evolved more in to that of a partisan politician rather than that of a parliamentarian (more rules and operations orientated).

It is one of the roots of our problems. To want an extreme/aggressive partisan deepens the problems rather than solves them. Disagreement is a good thing but the other side is not the enemy. In the end we are all Americans. The vilification of the other side I find quite sad. Both sides do it neither freely admits it.

I think he probably did or at the very least was told by a staffer who is plugged in. Here is a link on the House.gov website from the Clerk of the House with FAQ's where its explained under House Leadership and Officers. To be honest it wasn't until I saw the vote that I researched to see if a non House rep could be Speaker and sure enough they can.

I agree. I actually thought J. Dennis Hastert was a good Speaker of the House. Sure he was politically biased but he wasn't the mouthpiece of GOP policy. I believe the Majority/Minority leaders in the House should be the more partisan leaders and thats how it was when Hastert was Speaker. Tom Delay is a bitter partisan and was House Majority Leader.
