I could actually get serious here and tell you about what 'rights' are and how they differ from laws.

I could define inalienable so you might understand that means no one can restrict you, ever from a right, which would exclude smoking then.
I could explain how in our country those rights are listed in the first 10 ammendments of our Constitution and none mention smoking.
Then we might want to get into a conversation about how really we have no rights at all, we only have what those with power allow us to have and any of these 'inalienable' rights can be taken away at any time.
But what would be the point?

Legal definitions aside, it is not incorrect to use the term "right" when talking about our freedoms within the US.
