If they negligently failed to protect when they were capable of doings, then they should pay. Yes, it comes from the citizens' pockets, but maybe it will inspire voters to choose different government officials who will not permit this to happen again there. Hopefully...

Apparently, the city was facing a serious spoliation issue regarding a failure to preserve text messages between city officials, police, etc...

That jury instruction is a doozy.

I an guessing the city was anticipating the latter rather than the former (or at least an appearance of the latter), so they jumped into a settlement.

Geez, with that kind of wanton and intentional spoliation, I am surprised the settlement wasn't higher. The city would have gotten hammered in front of a jury, but I bet the businesses didn't want to wait/front the cash for the trial to happen...

Can you post the spoilation instruction?

Usually, they assert that due to the missing evidence, all inference that could be drawn from them and the loss/destruction/deletion are to be construed against that party. Plaintiff's lawyers' dream!
