Attorney becomes the second former Trump legal adviser to agree to cooperate with prosecutors

ATLANTA—Kenneth Chesebro, a former legal adviser to Donald Trump, pleaded guilty Friday to one felony charge in an agreement to testify for the prosecution in the Georgia racketeering case against the former president and others.

Chesebro is the second lawyer affiliated with Trump’s 2020 campaign, and third co-defendant, to cut a deal with prosecutors, after Sidney Powell, a legal adviser who played a leading role in the effort to reverse Trump’s election loss, struck a similar deal Thursday. Powell is also expected to cooperate with the prosecution.

Chesebro’s plea deal includes no jail time. He pleaded guilty Friday to one count of conspiracy to file false documents, which could have meant up to five years incarceration. Instead, he will serve five years of probation and complete 100 hours of community service. He was also ordered to pay $5,000 in restitution and to write a letter of apology to the people of Georgia.

Fulton County District Attorney Fani Willis in August indicted Trump and 18 other co-defendants on allegations they engaged in a “criminal enterprise” to subvert democracy as they sought to overturn Trump’s 2020 election loss in Georgia.

The plea deals are significant wins for Willis, who is trying to pit defendants against each other—a hallmark of racketeering, or RICO, cases. The large number of alleged participants in the scheme potentially gives Willis more leverage. Prosecutors often look to secure plea deals from some defendants in exchange for their testimony against the highest-profile targets.

All eyes are now on big-name defendants, especially Trump. In a press conference Friday, Chesebro’s lawyer Scott Grubman said he didn’t think Trump needs to worry about Chesebro’s testimony. Grubman said he would be surprised if Chesebro is called to testify in a trial for Trump.

“He didn’t snitch against anyone,” Grubman said. “He went in there and accepted responsibility for one of the minor, tag-on charges in the indictment.” Grubman said the plea deal was unlikely to result in Chesebro losing his law license.

Chesebro’s plea hearing took place even as potential jurors for the trial against him were gathering in another courtroom upstairs. He appeared in court in a dark blue suit, nervously adjusting his tie. He was free to leave the courthouse after entering his plea, but agreed to remain in Georgia for a few days to coordinate transferring his supervision to Puerto Rico, where his lawyer said he lives.

“I just want to thank you for how you handled these proceedings,” Chesebro said to Fulton County Superior Court Judge Scott McAfee as the hearing neared its end.

Chesebro previously rejected a plea deal from Willis’s office, his lawyer said Wednesday. Georgia businessman Scott Hall was the first to take a deal when he pleaded guilty to misdemeanor charges last month.

Chesebro is a former Democrat who attended Harvard Law School. For much of his career, he collaborated on legal cases with one of the university’s most prominent liberal scholars, Laurence Tribe.

Trial proceedings against Chesebro and Powell had been set to begin Friday morning in Atlanta with jury selection after the pair exercised their rights to a speedy trial and the judge ruled they should be tried together. All other defendants waived their rights to a speedy trial. The ones without plea deals are awaiting a trial date.

Prosecutors contend that the eight lawyers charged in the case went beyond legal advocacy and crossed into criminality. Chesebro is alleged to have “assisted in devising and attempting to implement a plan to submit fraudulent slates of presidential electors,” according to the indictment.

Chesebro has been called an architect of the alternate-elector plan. He sent a memo to GOP party officials in his home state of Wisconsin on Nov. 18, 2020, the earliest-known proposal to nominate new electors to prevent Joe Biden from receiving 270 electoral votes, which Chesebro then worked to replicate nationwide.

Chesebro’s guilty plea is damaging for Trump’s defense because it is a “direct admission that the so-called alternate elector scheme was, in fact, a crime,” said Clark Cunningham, a Georgia State University law professor.

Before Friday’s plea, lawyers for Chesebro argued he did nothing illegal and was merely advising the Trump campaign on constitutional law. A representative for Trump didn’t immediately respond to a request for comment on Chesebro’s deal.

“Nothing about Mr. Chesebro’s conduct falls outside the bounds of what lawyers do on a daily basis; researching the law in order to find solutions that address their clients’ particularized needs,” Chesebro’s lawyers said in a court filing last month.

Opinion Why Chesebro cut a deal and what it means for Trump

Lawyer Kenneth Chesebro peppered now four-time-indicted former president Donald Trump with written advice as to how he might overturn the results of the 2020 presidential election, knowing that no court had found evidence of fraud and that no state had withdrawn its delegates for Joe Biden. On Friday, after previously rejecting a deal, Chesebro pleaded guilty to one felony for conspiracy to submit a false document. In addition to accepting three to five years of probation and payment of restitution and a fine, he agreed to cooperate in other cases. This came after the plea on Thursday from former Trump lawyer Sidney Powell (of “release the Kraken” fame) to six misdemeanors; she, too, agreed to cooperate.

What became of Chesebro’s arrogant insistence he could not be prosecuted for giving “legal advice”? Simply put, Chesebro lost critical pretrial motions that made this defense practically impossible.

On Wednesday, Judge Scott McAfee “rejected Chesebro’s request to exclude from the trial key evidence in the case — memos in which Chesebro outlined how the Trump campaign could use Republican electors in states Biden won to help overturn the election,” the Atlanta Journal-Constitution reported. “Chesebro argued they should be excluded because they are protected by attorney-client privilege. But in his ruling, the judge rejected that defense, saying the memos are not subject to protection because there is some basis to believe they were used in the commission of a crime.” (That finding echoed U.S. District Judge David Carter’s decision regarding lawyer John Eastman’s documents. Carter ruled that Eastman could not claim attorney-client privilege for emails he had sent to Trump since they likely constituted evidence of a crime.)


On Thursday, Chesebro stood at risk of having other arguments barred. Fulton County District Attorney Fani Willis made four motions to prevent Chesebro from (among other things) advancing his planned defense. Chesebro wanted to argue that he lacked the requisite intent needed to convict because he believed his own legal theory that then-Vice President Mike Pence could throw out electors for Joe Biden. He also wanted to put a legal expert on the stand to testify to the merits of his crackpot legal theory.


In an amicus brief before Chesebro’s plea deal, a slew of former Justice Department lawyers, a state attorney general, U.S. attorneys and a former governor offered support for Willis’s motions, explaining that “the Georgia legislature has made a firm policy determination that individuals are assumed to know the law ... and the Georgia courts have repeatedly and conclusively precluded defendants from introducing evidence of or arguing mistake of law to the jury.” Allowing Chesebro to argue he believed his own crackpot theories would violate that prohibition and confuse the jury.

Likewise, the authors of the brief supported Willis’s demand to exclude expert testimony on Chesebro’s behalf that would lend credence to his crackpot legal theories. Experts testify as to facts, not the law; the judge should decide the legal issues, they argued.

If the judge had gone forward to rule that Chesebro could not argue mistake of law or call an expert witness, there would have been little for Chesebro to do at trial. Even attacking prosecution witnesses’ credibility would not have gotten him very far. His own writings incriminated him, which is why he struggled in vain to keep them out of trial. With no defense left, Chesebro took the plea offer.

Chesebro’s memos, dating from Nov. 18, 2020, through Dec. 24, 2020, would be devastating to any defense. Chesebro went from suggesting slates of alternate electors should be chosen in case a court threw out Biden electors to openly advocating that even in the absence of litigation, phony electors could be chosen and relied upon to deny Biden his rightful victory.

The Dec. 24 memo might have been the most devastating to Chesebro. The New York Times reported:


Mr. Chesebro argued there was little doubt that the litigation would fail in court — he put the odds of winning at “1
percent” — as Mr. Trump continued to push his baseless claims of widespread fraud, according to emails reviewed by
the New York Times.


But the “relevant analysis,” Mr. Chesebro argued, “is political.”

Thus, by his own admission, this was not dispassionate legal advice but a political gambit dressed up in legalese. Chesebro even suggested that part of the rationale for advancing far-fetched legal arguments was to instill in the Supreme Court “fear that there will be ‘wild’ chaos on Jan. 6 unless they rule by then, either way.” Stoking fear of violence hardly qualifies as legitimate legal advice. Moreover, Chesebro’s appearance on Jan. 6, 2021, alongside Infowars host Alex Jones confirms he was not acting as a lawyer but rather, as Willis alleged, a player in a “criminal enterprise” (under RICO law) to subvert the election.

The Powell and Chesebro pleas should have Trump quaking in his boots. “Trump’s illegitimate assault on the outcome of the 2020 election stood on two legs: the factual assertion that he had actually won and the legal claim that he had the right to use false electoral certificates to have Vice President Pence change the outcome in Congress on Jan. 6,” Norm Eisen, counsel for the writers of the amicus brief described above, told me. “With the guilty plea of Sidney Powell, the first [former lawyer] was knocked out from under the former president. Now, with the guilty plea of Kenneth Chesebro, the second has also fallen away.” In short, Eisen thinks, “Trump is toast.”


Chesebro likely will not be the last defendant to take a plea deal. Other Trump lawyers, including Jenna Ellis, Rudy Giuliani and Eastman, will feel pressure to make their own deals or face a jury that will hear former co-counsels Powell’s and Chesebro’s testimonies.

Politically, lawyers Dennis Aftergut and Austin Sarat argue, “it’s reasonable to expect a drip, drip, drip of information ferreted out by energetic reporters in the media about cooperators’ knowledge of Trump’s role in trying to overturn our democracy.” That might not shake his core MAGA supporters, but it could scare the daylights out of GOP regulars who will see their 2024 hopes going up in smoke.

In any event, we can expect Willis, with a total of three plea deals, to return to court, seek trial dates for remaining defendants and then ramp up pressure to snare more cooperating witnesses. Even Trump must recognize she’s on a roll.

Com'on Robert. We are not all naive and blind to see how things work in Fani's devil's court.
The outcome was predetermined, if is plead guilty and promised to turn on her client at a future date and they would let her off with a slap on the wrist. It was either that or she would tortured by being dragged through the time and expense of a jury trial.

You only THINK you know how this stuff works. She pleaded guilty, not no contest, and admitted what she did was wrong/
illegal. She isn't going to get just a slap on her wrist. She will lose her law license She'll also be subjected to the Trump minions. I am willing to bet she gets threats from the Trump minions.

these three, Powell, Chesebro and Ellis, who accepted deals that included admitting guilt to felonies, were all very bright attorneys at one time (why would Trump hire them were they not?) and then fell under the spell...their lives and reputations are ruined...one doesn't cut a deal admitting guilt to a felony that effectively prevents you from making a living at one's profession...nor does one cut a deal when they are certain that they will prevail when the case is tried...

their behavior in trying to overturn the results of a free and fair Georgia election and turn the loser (whose own words will be used against him-- "just find me 11,780 votes") into the winner, was majorly unlawful, felonious, illegal and criminal

Jenna Ellis, at sentencing: I have deep remorse. I should have checked to be sure that what other lawyers with more experience than me were saying was true.


If you're Giuliani and Eastman, lawyers with more experience than Ellis, and ultimately Trump, you're prolly saying that "this is nothing, just a flesh wound"

She pleaded GUILTY TO A FELONY. She can't be a lawyer anymore. She can kiss her good life goodbye.

I'd give Trump, relative to Ellis' slap on the wrist, his own similar deal if he were to just end this all by making a grand bargain in all the cases at once- and continue on with his campaign without everything else in the background.

GUILTY PEOPLE WITH LAWYERS PLEAD "NO CONTEST". She chose to do what she thought was the right thing. You would too.
