If you missed the arguments outside the presence of the jury which went on until 10pm, you missed some of the best legal arguments regarding technical evidence and its admissibility I have ever seen. Don West may come off as boring, but he demonstrated razor-sharp skill examining witness to try to get Treyvon's cell phone evidence in front of the jury.

The defense argued that it is relevant and represents Treyvon's propensity and prior similar bad acts. The state's retort is that the text messages cannot be authenticated as being made by Treyvon. Both sides are right, but I feel the defense's argument is wrong. The information is relevant, but its value is outweighed by unfair prejudice. Also, evidence destroying Trevon's character when no one has first bolstered it.

The second argument was about a video reconstruction of the events the defense wants to show the jury. The state objects on the grounds that there is no basis for the video because the info shown in it has not been authenticated by any witness and Z will have to testify to its accuracy. The video reconstructionist testified that the video was created based upon the police report and other evidence, including the videos of Zimmerman made by the police. I think the video should be admitted as a demonstrative aid, but someone needs to testify as to every object, item and movement in the video. That would involve putting Z on the stand, which I think would be a terrible risk to take. However, the law doesn't require the reconstruction video to be an exact replication; only one that is close enough to be of help to the jury in understanding what occurred.

Defense could lose on both of these issues. If the defense wins anything, it will be to use the video as a demonstrative aid- not evidence. They would get to show it to the jury. Then, the case will be 100% over IMO. Z would be found not guilty. My call is that the defense rests today or tomorrow and then the state will put on some rebuttal witnesses. The case should go to the jury Friday. I predict as of now that Z is not guilty unless he testifies, in which case all "bets are off."

The judge really disappointed me last night. I know that everyone in that case is exhausted. She did not seem to me to be listening to Don West's arguments, but was instead doing case related paperwork such as reading the cases and law that were being argued. She is also pushing the defense too hard to move the case forward like a runaway train. There is no way that she could have made a reasoned decision after 10pm, but before 9am this morning; sleep and go about her activities of daily living. The defense lawyers had from 10pm last night until 9am to sleep; go about their activities AND prepare their witnesses for this morning/today.

Treyvon's phone apparently had photos of weed, handgun, etc. He was apparently looking to buy a handgun from the fat woman who testified against Aztec Jimmy the other day. Another friend also wanted fighting tips from the dead man...

Charging Conference is the first item on the agenda today. Both sides will present each other with a version of Standard Jury Instructions they propose. Everything both agree on will be part of the Jury Instruction. Judge will rule on any Instructions they cannot agree on. Expect a request (Motion) from the defense to drop Manslaughter- to avoid a "compromise verdict" where the jury agrees he is not guilty of 2nd degree murder, but believes he did something wrong and Manslaughter is their only choice left. Sadly, the pressure and gruel of this trial have gotten to the Judge. She was very widely considered a fine jurist before this case and must eventually face reelection. I disagree with her highly uncharacteristic demeanor.

I see CNN and NBC are now hopeful for a manslaughter or other lesser charge since 2nd degree seems an impossibility.

wow, they are even trying to get him for felony murder child abuse or something if manslaughter wont stick. I see him getting convicted on one of the lesser charges for sure now. the masses must be appeased.
