I'm in favor of background checks, and since I do them here in CA, I know how long they take. Minutes. Nation wide checks may take up to a couple days. But I see nothing wrong with proper vetting of potential gun owners/buyers if done in a timely manner.

I don't want people with serious mental health issues buying or owning guns. It's just not smart. But I don't know what classifies as serious... and I suspect only a professional psych doctor could tell you that. It is my understanding that the law, as written, was restricting people that did not need to be restricted.

*shrug*

I still think about the case in California somewhere where a kid was on Ritalin or somethin so they came in and took his Uncle Joe's guns cause they were in the same house... I suspect this is what Obama had in mind... 😟

I agree with drafter, I think if you're on any pills whatsoever the government wants to take away everything not only your property but the property of those around you. It's not right to the individual.

I'd love to read an IN DEPTH STORY
On the whole CLUSTER ****
BARRY SIGNED OFF ON
CALLED
FAST AND FURIOUS.....

ONCE YOU'VE BEEN IN "THE GAME" for literally
D.E.C.A.D.E.S....
YOU get damned tired of all these
Operation & PROJECT NAMES....

THERE HAVE been so *****in' many "OP's" that
These top level law dogs and intelligence spooks have used the same name 2 or 3 times....

Then the DUMB *****S get all confused and these
YOUNG MILLENNIAL DOUCHE BAG NEW HIRES
start running the show and "GO ALL VIN DESIEL"
On the names....

If I had to guess about "fast and furious"...
A side angle was used... that was never conceived of by MORONIC FBI ANALYSTS and a smart CRIMINAL made a TON OF MONEY OFF THE U.S. GUBMENT.
I thought a few AGENTS? Or stoolies were shot or killed with the same guns they sold to the cartels?
Is what I heard on TV on time?

And #64 jjaneka

If they took all the guns from people "who took pills"
25-40% of all LOCAL COPS, FBI, ATF, Federal Marshalls, JSOC, HOMELAND SECURITY
WOULD BE UNABLE TO CARRY A GUN....
AND
75% of the ENTIRE FBI-SSG DIVISION
WOULD ONLY be able to CARRY PEPPER SPRAY, battons
And tasers...the other 25% FBI-SSG AGENTS WOULD BE IN MENTAL HOSPITALS FOR LIFE.

FBI runs the federal system, and they are actually fast with it unlike the class 3 items. Here in Oregon they've opted out and have the OSP run it (again insuring more state union jobs, and an avenue of control with the governor running the OSP). They've also admitted to keeping records permanently when the law states no longer than 3 years which is also excessive.

Not my experience with the FBI system nor with my FFL or the gun show vendors I've spoken with. They can return Proceed, Delay, Deny. Delay is the kicker because the number of delays has climbed dramatically to the point they are common. When I got my CZ 4 or the 5 folks before me got the delay. Delay is supposed to be for 3 days or less (then they can give the gun and if it comes back as deny you get visited by ATF and lose your gun.) In reality many FFLs simpy will not give you the gun until proceed (thank san bernadino for that)

On the Federal level this link pretty well covers the entire gambit of who gets denied and why. This is based on the assumption that the buyer is purchasing his / her gun through a licensed FFL

From the attached link:

NICS also consults medical records submitted by each state. According to a 2013 congressional report, these records can show whether someone has been “adjudicated as a mental defective” by a “court, board, commission, or other lawful authority,” or has been involuntarily committed to a mental institution — both circumstances would bar someone from purchasing a firearm. However, federal law does not require states to forward mental health records to NICS, and some states are resistant, citing privacy laws.

funny part is passing a security clearance appears to trigger NICS delays

San Bernardino? Those folks had their guns bought for them. The guy who bought them plead guilty and will soon be sentenced.

No matter how many laws are passed or how stringent background checks are, bad actors will always find a way to acquire a gun. People need to stop being victims and take responsibility for their own protection. Call 911 and wait just won't get the job done.

I think.... and this is from my FFL so I don't know.... that the origin of the guns to the other dude was clean from the FFL end BUT it involved a Delay response in which the FFL LEGALLY let the guns go (what the dude did from there was not legal). The FFL did nothing wrong.

However the anti gun nuts are still suing them. While they will likely win if they had not already, the FFL suffered huge attny fees and it cast a pall over many FFLs that would legally release the gun. At least that is why he stopped doing so. It is also why gander mountain, cabellas etc stopped doing so (obammy pressure).

Yes technically if the delay runs long they can release it... in reality I wouldn't if I was them.

I've not checked the veracity of the story and don't really care. I just know many ffls will not release the gun after a 3 day delay even though they can because they don't want to be at risk of a suit by zealots.

I was delayed for about 2 weeks, and while you never get a reason I suspect it is because both my wife and I have gone through pretty extensive security clearances as of late which means pings on the file, and data systems not available to first line reviewers. No gun for TEE during that time.

I agree, TW. They should have 2 responses. Proceed/Deny.

If the shop selling the gun doesn't get a YES or a NO in the time allotted, consider it a NO until you hear otherwise. The DELAY just creates confusion... and if you can legally give the buyer the gun and it comes out as NO a day later... WTF?

MACS, I'm not into denying rights without a timely appeal.

If the left wasn't using this the way they are I might feelore moderate in this but alas....
