Chief Economic Adviser Refuses To Admit Biden Is Lying About Inflation



Joe Biden’s chief economic advisor refused to admit Thursday that the president keeps telling a huge lie by claiming that inflation was at 9 percent when he took office when it was really at 1.4 percent and shot up to 9 percent under Biden himself.

During an interview on Fox Business, host Neil Cavuto grilled Jared Bernstein, and told him directly “you’re lying,” and “just as bad” as Biden when he tried to dodge the matter.

After Biden took office inflation surged to rates unseen since the early 1980s, peaking at an annual rate of 9.1 percent in June 2022, a full 17 months after he became president.

Yet, he keeps claiming it was ALREADY at 9 percent and that he inherited a weakened economy from Trump.

“Jared, why does he keep saying that?” Cavuto asked, following up “You’re the head of the Council of Economic Advisers. Do you ever whisper in his ear, ‘Mr. President, just to be technical about it, it wasn’t at 9% when you assumed office, it was 1.4%. It got as high as 9% in 2022, you brought it down from that, but it was never ever ever 9% when you came into office.’ So why does he keep saying it?”

Bernstein responded “Well, first of all, let me point out that in that very quote you played, the president talked about how concerned he was, uh, for households struggling with prices that he consistently—”

“That’s not what I asked you. That’s not what I asked you,” Cavuto interjected, again asking “Why does he keep misrepresenting this?”

“He’s making the point, uh, that that factors that caused inflation to climb to 9% were in place when he took office,” Bernstein claimed.

Credit to Cavuto, he was having none of it.

“No, that’s not what he said! He said it was at 9%… So if I can’t trust him with quoting data in real-time, why should I believe what he’s talking about now?”

“No it wasn’t — it was not at that! You’re almost as bad as he is,” Cavuto further charged when Bernstein attempted to claim that the annual inflation in 2021 was “about 9 percent.”

“Why can’t you just say, ‘It was high, it got as high as 9%’ — you’d be accurate in saying that — And we have now brought it down, or were struggling around the 3% area, but it’s better than it was,’” Cavuto continued.

“But instead to hang it on his predecessor that you inherited something that was through the roof when we were in the middle of Covid, it just seems to the American people whether you’re a Republican or a Democrat — you’re lying!” The host concluded.

Biden really seems to believe that he has rescued the economy, when in reality he’s overseen an unmitigated disaster.

Unexplainable. I will never believe that the 2020 election was fair and square. Far too many shenanigans with changing the rules at the last minute, destroying ballots that were supposed to be preserved, Covid ballot harvesting. I’m not clever enough to make a claim that specific laws were broken and provide support for my argument. I do not believe that the 2020 election was fair and square though.

On Monday afternoon, the Biden Administration sent their condolences to Iran for the death of the Tehran regime’s president, leading to lots of anger and confusion amongst Americans who believe that our country should defend the basic principles of our founding.

In tragic and revolting fashion, our government “expressed its official condolences” for the now-deceased Ebrahim Raisi, who was nicknamed “The Butcher of Tehran” for his role in overseeing the execution of thousands of political prisoners.

The U.S. Institute of Peace describes Raisi as “a pivotal player in the mass execution of thousands.” As a member of Iran’s “Death Committee,” Raisi “decreed that all prisoners steadfast in their support for the opposition and ‘waging war on God’ were ‘condemned to execution.’”


In 2024, Americans live under a government committed to a combination of progressivism and nihilistic nothingness, under a series of bureaucratic agencies that don’t stand for anything other than leftism and the capture and retention of power. Our Founders would almost certainly observe the mess in D.C. as something completely detached to their Declaration and vision for America.

“The United States expresses its official condolences for the death of Iranian President Ebrahim Raisi, Foreign Minister Amir-Abdollahian, and other members of their delegation in a helicopter crash in northwest Iran,” read a State Department statement released at around noon. “As Iran selects a new president, we reaffirm our support for the Iranian people and their struggle for human rights and fundamental freedoms.”

There are 90 million people in Iran suffering under the weight of the barbarian mullahs. Imagine how these poor souls are feeling after witnessing that the country that is supposed to, at a bare minimum, stand for unalienable freedoms, but are instead excusing the actions of their captors?

To be clear, I am no advocate for the idea that we should repeat the lunacy of hyper interventionist foreign policymaking, and proceed to forcefully intervene in Iran’s political system. The era of Team America: World Police is coming to an end, necessarily so.

However, committing to a hands-off approach to the internal affairs of foreign governments doesn’t mean that the United States needs to *express condolences* for a throwback theocratic thug.

An American administration worthy of our founding would reject the idea that any such statement or expression of solidarity is warranted. If you’re going to release a statement, tell him and the gang of thieves that smashed their helicopter into a mountain to enjoy hell, and call it a day.

The galaxy brained idea of Iran as a potential ally goes back to the Obama days, when the extreme partisans at 1600 Penn (who remain in the White House today) decided to attempt to realign American interests in the Middle East to favor Tehran over our established allies. A very, very generous steel man interpretation of this policy is that it came with the hopes of changing the behavior of the donkey riding mullahs. Yet today, the people in charge still chant “death to America” every Friday during prayers.

And it wasn’t just the United States government that “expressed condolences” for the bad guys.


Almost the entirety of the U.N. membership roster and other transnational outfits, treated the death of Raisi as if it was an event worthy of sorrow. This included institutions controlled by the U.S., like NATO and countless additional outfits under our historic umbrella.

The Biden Administration and its partners, either willfully or mistakenly, cannot or will not morally discern between Iran and the West.

We find ourselves in an America that desperately needs to draw from our foundational roots, to once more find the courage to align more closely with like-minded forces for liberty, and to push away the world’s most brutish tyrants, while also realizing our limitations and priorities.

We need to go back to an America that stands committed to its founding principles, both at home and when discussing events occurring abroad.

Biden Lawsuit Against Sheetz Gas Will Enrage Pennsylvania Voters



ALTOONA, Pennsylvania -- The oldest gas station in America still in operation, Reighard's here in this Blair County city, got its start in 1908 when a local blacksmith decided to sell gasoline out the back of his shop when the Model T was introduced.

It has been open ever since. While architecturally it is underwhelming, the service is good because the people who work there care about the work they do, whether it is pumping gas, washing your windshield or doing minor fixes on your car. It is important to them that you return.

While Reighard's holds the title of the oldest gas station in the country, it was another Altoona family that put a different kind of gas station excellence on the map. The Sheetz family story is one of struggles. This family-friendly service station struggled with a salmonella breakout in 2004, but it retained a deeply local customer base and expanded well beyond its western Pennsylvania roots.

Ask any traveler in Pennsylvania, West Virginia, Virginia, Maryland, Ohio and North Carolina and they'll tell you when they see the cheery red and yellow stations along their drives, Sheetz means quality and comfort to their loyal customers.

One very loyal and vocal customer is Sen. John Fetterman (D-Pa.), the Braddock Democrat who often posts on X his preference for Sheetz over Wawa, the other mega service station based in the state, with cheeky posts such as "Sheetz > Wawa."

With so much loyalty among residents in the state, it made sense for President Joe Biden to do a photo-op at a Sheetz in suburban Pittsburgh last week after his visit with local steelworkers. He wanted to demonstrate that he is no different than any other Pennsylvanian in his affection for the family-owned business.

Biden even went so far as to pick up sandwiches for construction workers after pulling the presidential motorcade into the Sheetz gas station in Moon Township. Wearing his aviator glasses, he posed for a selfie with an employee.

Then things got weird.

Just one day after the president's orchestrated Sheetz run, the Biden administration hit the privately held convenience store chain with a federal lawsuit in which federal officials say the company discriminated against minority job applicants. The theory, according to the Equal Employment Opportunity Commission, is that because the company uses criminal background checks to screen job seekers, somehow that's a violation of Title VII of the 1964 Civil Rights Act.

The Civil Rights Act prohibits workplace discrimination on the basis of race, sex, religion and national origin. EEOC attorney Debra M. Lawrence wrote that criminal background checks "cause a disparate impact because of race or other protected classifications."

Lawrence went on to say the employment hiring practices must be shown by the employer to be necessary to ensure the safe and efficient performance of the particular jobs at issue.

"Even when such necessity is proven, the practice remains unlawful if there is an alternative practice available that is comparably effective in achieving the employer's goals but causes less discriminatory effect," Lawrence added. The suit said Sheetz discriminated against Black, Native American and multiracial job seekers by weeding out applicants who failed a criminal background check.

Logic says EEOC's underlying assumptions are that nonwhites are criminals. That's absurd and insulting.

Sheetz employs nearly 25,000 employees in a stretch of Appalachia that cuts diagonally through Pennsylvania, West Virginia, Virginia, Maryland, Ohio and North Carolina. The company gives back to the community through a charitable foundation and has a tradition on the Fourth of July of honoring customers by rolling back prices on all types of fuel except diesel at all 675-plus locations. That day's fuel cost is always $1.776 per gallon, a tribute to the founding year of 1776.

Going after Sheetz is like tugging on Superman's cape in Pennsylvania, in particular in central and western Pennsylvania when pulling up to a Sheetz is like pulling up to home. This is especially so when the alleged "violation" is what common sense says is just good business practices, such as making sure employees who interact with the public aren't criminals.

Like the Biden administration's pause of exports of American liquefied natural gas, which harms hundreds of thousands of jobs in the state, or his proposed rule for the 45V hydrogen production tax credit that would cut Pennsylvania workers out of the equation in the hydrogen industry, the Sheetz lawsuit has local Democrats shaking their heads.

As one Democrat said privately, "Is [Biden] just trying to lose Pennsylvania?"

Biden Drains Entire Northeast Gasoline Reserve In Bid To Lower Gas Prices As He Trails Trump By Double Digits



Back in March, when reading the mammoth, 1050-page bill that was meant to avert government shutdown, but was yet another pork filled free-for-all bonanza authorizing $1.7 trillion in in discretionary spending, we stumbled upon something that was truly shocking: after Biden singlehandedly drained half of the US strategic petroleum reserve to avoid obliteration for Democrats in the 2022 midterm elections, Congress has snuck in a provision that would sell off and shutter the Northeast Gasoline Supply Reserve, a move that while perhaps keeps gas prices lower for a day or two, would also leave the entire continental northeast defenseless to any true environmental catastrophe or shock. We were so dismayed by the inclusion of this particular text, we wondered if it hadn't been put there solely for the benefit of America's enemies...

... because surely nobody in their right mind, not even the illegitimate senile occupant of the White House, would ever pursue such short-term gains at the expense of potentially disastrous long-term consequences to the entire nation.

We were wrong: earlier today, just two months after the bill was signed by Biden into law, the panicking administration announced that it would sell the nearly 1 million barrels of gasoline in the US managed stockpile in northeastern states, the Department of Energy said, effectively closing the reserve.


The department created the Northeast Gasoline Supply Reserve (NGSR) in 2014 after Superstorm Sandy left motorists scrambling for fuel. But, according to some megabrains hoping to justify the dumping of gas so its price drops for a few weeks ahead of the summer and avoid even more anger aimed at the president, storing refined fuel is costlier than storing crude oil, so closing the reserve was included in U.S funding legislation signed by President Joe Biden in March.

Bids to buy the gasoline located at the two NGSR storage sites in Port Reading, NJ (900,000 bbl) and South Portland, ME (98,824 bbl), are due on May 28 and the Treasury Department's general funds gets proceeds from the sale. Incidentally, the proceeds from the reserve liquidation - which will amount to roughly $125 million gross (and far less net) - is roughly how much the government spends every 15 minutes!

So is it better to have a gasoline reserve for unexpected events, or to fund a quarter hour of US government's spending? Don't answer that. Of course, the answer is neither - the whole point of selling the gasoline is to depress prices at the pump if only for a few days to help Americans forget about the great inflationary nightmare they have been in for the past 3 years.

The volumes will be allocated in quantities of 100,000 barrels with each barrel containing 42 gallons, the department said and said it would require that fuel is transferred or delivered no later than June 30. That will ensure the gasoline can flow into local retailers ahead of the Fourth of July holiday and that it will be sold at competitive prices. Translation: Biden just drained the Northeast strategic gasoline reserve to push gas lower by a few cents on July 4.

For context, gas prices at the pump this Memorial Day will be the second most expensive in a decade - dramatically above the ten-year average of $2.91...

“By strategically releasing this reserve in between Memorial Day and July 4th, we are ensuring sufficient supply flows to the ... northeast at a time hardworking Americans need it the most,” Energy Secretary Jennifer Granholm said in a release.

“The Biden-Harris administration is laser-focused on lowering prices at the pump for American families, especially as drivers hit the road for summer driving season,″ Energy Secretary Jennifer Granholm said in the statement. “By strategically releasing this reserve in between Memorial Day and July 4th, we are ensuring sufficient supply flows to the tri-state (area) and Northeast at a time hardworking Americans need it the most.”

White House Press Secretary Karine Jean-Pierre said release of gas from the Northeast reserve builds on actions by President Joe Biden, a Democrat, “to lower gas and energy costs — including historic releases from the Strategic Petroleum Reserve and the largest-ever investment in clean energy.″

Biden significantly drained the Strategic Petroleum Reserve in 2022 following Russia’s invasion of Ukraine, dropping the stockpile to its lowest level since the 1980s after selling about 280 million barrels to keep prices low. The election year move helped stabilize gasoline prices that had been rising in the wake of the war in Europe but drew complaints from Republicans, and frankly anyone with half a brain, that the Democratic president was playing politics with a reserve meant for national emergencies.

The Biden administration has since very theatrically begun refilling the oil reserve, which had more than 364 million barrels of crude oil as of last month, by purchasing a couple million barrels every other month or so, setting it on pace for refilling some time in the 2100s.

“While congressional Republicans fight to preserve tax breaks for Big Oil at the expense of hardworking families, President Biden is advancing a more secure, affordable, and clean energy future to lower utility bills while record American energy production helps meet our immediate needs,” Jean-Pierre said.

As for the real reason behind the latest myopic decision by the Biden admin, today we learned that Trump’s lead over Biden has widened to 13pp in the betting market, the largest difference since mid-March. Meanwhile, political event prediction website PredictIt places higher betting odds on Trump than Biden for the first time since March.

Trump is also leading in the latest polls of all swing states.

Trump is leading by 2% in the latest polls in Pennsylvania. If Biden loses Pennsylvania but wins Wisconsin and Michigan, he then at least needs to win one state from Georgia and North Carolina in addition to one state from Arizona and Nevada to secure a second term.

Meanwhile, closing arguments in Trump's "hush money" case in New York are set to being on May 28. If the jury finds Trump guilty, it is possible for the former president to receive prison time, and judging by how weaponized the "legal system" of the current fascist regime has become, we would not be surprised if Biden goes there.

'Deadly Force' An Option: New Docs Show FBI Agents Were Prepared For Secret Service Resistance At Mar-a-Lago



FBI agents executing a search warrant at former President Donald Trump’s home in 2022 prepared for the possibility U.S. Secret Service agents resisted the agents, according to newly unsealed court documents.

An operations plan for the raid of Mar-a-Lago in southern Florida stated that should President Trump arrive at Mar-a-Lago during the period when agents were there, FBI agents would be prepared to “engage with” him and U.S. Secret Service (USSS) agents who protect him.

If the Secret Service agents “provide resistance or interfere with FBI timeline or accesses,” then FBI officials would contact certain individuals—their names and positions were redacted—the documents stated.

The documents also stated that if Mar-a-Lago employees refused to provide a list of occupied guest rooms, FBI agents would “knock on each guest room door to determine occupation status.” Agents would request a map, list of rooms, and a skeleton key for all rooms, and were preparing to bring lock-picking equipment with them.

The documents, produced to President Trump through discovery in the criminal case against him, were placed on the docket on May 21.

President Trump’s lawyers attached the documents as exhibits to a motion asking to suppress evidence seized by agents, arguing the raid was unconstitutional.

The warrant was cleared by a U.S. magistrate judge after agents said there was probable cause to believe sensitive materials were being kept at unauthorized places at the resort. Officials said the raid would likely uncover evidence of obstruction of justice.

Agents arrived at Mar-a-Lago at 8:59 a.m. on Aug. 8, 2022, and initiated the search at 10:33 a.m.. A summary of what transpired stated that FBI leaders coordinated with local Secret Service leaders and that Secret Service agents “facilitated entry onto the premises, provided escort and access to various locations within, and posted USSS personnel in locations where the FBI team conducted searches.”

In addition to 25 FBI employees from the bureau’s Miami office, the group of DOJ personnel included five officials from Washington and two DOJ lawyers.

The group took numerous photographs, including pictures in the bedroom of former First Lady Melania Trump and a “child’s bedroom suite,” according to picture logs that were released on Tuesday.

President Trump’s lawyers said in the motion that the search was “roving and highly inappropriate,” citing how it covered a gym, a kitchen, and the bedrooms where the pictures were taken. They said the warrant was too broad and authorized agents to seize virtually any document from Mar-a-Lago.

Government officials have acknowledged they improperly seized passports and some other materials.

Agents remained on the scene until 6:39 p.m. They flew the seized evidence to Washington the following day.

President Trump after the execution of the warrant was charged with mishandling of national defense information, concealing documents, and making false statements.
Deadly Force an Option

The documents included a statement on the use of deadly force, which quoted government policy in stating that “law enforcement officers of the Department of Justice (DOJ) may use deadly force only when necessary, that is, when the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.”

The FBI also brought a medic and paramedic along on the raid, according to the documents, and listed the nearest trauma center in case anyone was injured during the execution of the warrant.

Agents were equipped with standard issue weapons, ammunition, handcuffs, and badges, and brought medium and large bolt cutters.

There was no basis for the FBI to bring guns into Mar-a-Lago, according to President Trump’s lawyers.

“There were no threats and no risk to agents’ safety arising from their allegations relating to possession of documents at a premises already guarded by the Secret Service,” the lawyers said.

The lawyers also argued that an FBI agent omitted relevant information from the affidavit submitted to the judge as part of the request to authorize the warrant.

The agent, for instance, “failed to disclose that presidents are not required to obtain clearances and that sensitive briefings including classified information had been provided to President Trump at Mar-a-Lago and other residences before and during his presidency,” the lawyers said.

In a DOJ filing in response to the motion, government attorneys countered the arguments.

“Regardless of Trump’s authority during his presidency, he lacked authority to possess classified documents at Mar-a-Lago after it ended and he became a private citizen. Trump’s authority to access or possess classified documents during his presidency was both obvious and immaterial to the probable cause determination regarding the retention of the documents after his presidency,” they wrote in part.

The attorneys also said that while some FBI officials did suggest seeking the consent of former President Trump to search Mar-a-Lago before seeking a warrant, his “prior obfuscation and deception up to that point” meant there was “ample reason to avoid seeking Trump’s consent, which would simply invite more deception.”

DHS Admits Border Has Been Open To Criminals And Terrorists



The Biden administration’s experiment with a relatively open southern border has been shocking in the sheer number of people who have come across in just over three years, estimated to be about ten million. But the most shocking thing about the border policy may have just been revealed.

The Department of Homeland Security (DHS), headed by the impeached Alejandro Mayorkas, recently proposed a new rule. In a statement announcing the rule, DHS unwittingly revealed that it has not been doing background checks on these millions of illegal immigrants in order to immediately deport those with criminal records or terrorism ties. Instead, they have been leaving that determination until the asylum hearing, which occurs many years down the road. In the meantime, they remain in the U.S. awaiting the hearing.

First, it should be noted that the whole premise upon which these millions of illegal immigrants are permitted to enter the United States is absurd. People are free to cross almost anywhere they please along our nearly 2,000-mile southern border. They are typically not required to enter through an official entry point. Cross the desert, the mountains, or the river at a place of your choosing (or, more accurately, at the drug cartel’s choosing). No problem, we will bring border patrol to you and gladly process you right there and allow immediate entry.

They are processed and allowed in because they are being treated as refugees seeking asylum, not illegal immigrants as before. That is the hook and the key to the open border experiment. U.S. immigration law (Title VIII, Section 1158(b)) provides, “To establish that the applicant is a refugee ... the applicant must establish that race, religion, nationality, membership in a particular social group, or political opinion was or will be at least one central reason for persecuting the applicant.”

But the vast majority of these immigrants are not coming here to escape persecution. They are coming because they are poor, which has never been grounds for asylum. If they were escaping persecution, where are the reports of millions of central and south Americans being persecuted because of their race? Where are the reports of millions being persecuted because of their religion?

The vast majority of illegal immigrants will be denied asylum at their hearing years down the road because they do not qualify. But now we learn that not only does DHS allow people to remain in this country for years despite knowing they do not qualify for asylum, DHS allows known dangerous immigrants to remain here.

“Federal law bars individuals who pose a national security or public safety risk from asylum,” DHS states.

Yet, the agency acknowledges, “the asylum eligibility determination is not currently made until later in the process—at the merits adjudication stage of the asylum and withholding of removal claims.”

We know that only occurs years later. The statement announces that the “proposed rule would permit Asylum Officers to consider these bars to asylum and withholding of removal during initial credible fear screening, which happens just days after an individual is encountered.” This, according to the statement, “will allow DHS to expeditiously remove individuals who pose a threat to the United States much sooner than is currently the case, better safeguarding the security of our border and our country.”

After over three years of allowing in millions of illegal immigrants, DHS has just now come up with the idea that maybe, just maybe, it is a good idea to deport those with violent criminal histories and ties to terrorism immediately instead of after their asylum hearing years down the road.

It gets worse.

They still have not changed the policy. Incredibly, they propose this as an administrative rule change, requiring a period for public comment. Comments are due by June 12. Thus, the rule cannot even take effect until later this summer.

If President Biden can overturn former President Trump’s remain-in-Mexico order with his own order on day one, a move upheld by the U.S. Supreme Court, why can he not issue another order changing this policy immediately? Of course he can, but this administration, while seeking to now look tough on illegal immigration just in time for the election, is not in any hurry to reduce the number of immigrants coming across.

According to the statement, “Noncitizens who present a national security or public safety risk remain in DHS custody while their cases are referred for full immigration hearings before an immigration judge, a process that can take years and is resource intensive.” Thus, some illegal immigrants are currently not released into the country, according to DHS. Instead, apparently, taxpayers foot the bill for their room and board for years while they await their asylum hearing, which DHS often already knows they will fail because of their criminal or terror related past.

But there is good reason to believe they are not all, in fact, detained. A DHS senior official recently told reporters on a call about the proposed rule: “I will say this is really intended to be a national security and public safety measure. And so it is intended to ensure that, again, the individuals that we are most concerned about that we encounter—people with serious criminal histories or links to terrorism—can be removed as early as possible in the process.”

If they are detained for years until their hearing as they claim, then how is this a national security and public safety issue? Clearly, because this has not always happened, and it appears DHS now realizes they have a serious security problem.

Just look at the case of Jose Ibarra, the alleged murderer of Laken Riley, a nursing student who went out for a jog on the University of Georgia campus and never returned. He was first arrested in September 2022 by Customs and Border Patrol officials near El Paso after crossing the border illegally. He came from Venezuela. He was then “paroled and released for further processing,” according to border officials. Paroled means you are free, awaiting your asylum hearing years down the road. He was put on a bus to New York. There he was arrested for endangering a minor. Since New York is a sanctuary city, ICE was not notified. He was arrested again in Athens, Georgia for shoplifting. Athens is a sanctuary city. Again, ICE was not notified. He then allegedly killed Ms. Riley.

There are no reports about his criminal record in Venezuela, but considering his criminal record over a period of months here, odds are he has one.

In likely related news, the FBI and DHS recently issued a joint public service announcement warning that foreign terrorist organizations could target events during Pride Month. In particular officials cited “ISIS messaging” focused on “anti-LGBTQIA+ rhetoric.” Why is the FBI and DHS suddenly concerned about ISIS in the U.S.? Could it be that people with ties to ISIS have crossed our southern border in the last three years?

And we learned last week that two illegal immigrants tried to drive a box truck past security guards and onto a Marine base in Quantico, Virginia earlier this month. The Potomac Local News reported that one of them is a Jordanian national who had recently crossed the border, and that at least one was on the U.S. government’s terrorist watch list. A similar incident occurred in March when an illegal immigrant from China forced his way onto a Marine base in Twentynine Palms, California.

Now that we know how DHS has been handling illegal immigrants with criminal records or terrorism ties, this all makes sense. The agency clearly has a major problem on its hands.

'Deadly Force' An Option: New Docs Show FBI Agents Were Prepared For Secret Service Resistance At Mar-a-Lago



FBI agents executing a search warrant at former President Donald Trump’s home in 2022 prepared for the possibility U.S. Secret Service agents resisted the agents, according to newly unsealed court documents.

An operations plan for the raid of Mar-a-Lago in southern Florida stated that should President Trump arrive at Mar-a-Lago during the period when agents were there, FBI agents would be prepared to “engage with” him and U.S. Secret Service (USSS) agents who protect him.

If the Secret Service agents “provide resistance or interfere with FBI timeline or accesses,” then FBI officials would contact certain individuals—their names and positions were redacted—the documents stated.

The documents also stated that if Mar-a-Lago employees refused to provide a list of occupied guest rooms, FBI agents would “knock on each guest room door to determine occupation status.” Agents would request a map, list of rooms, and a skeleton key for all rooms, and were preparing to bring lock-picking equipment with them.

The documents, produced to President Trump through discovery in the criminal case against him, were placed on the docket on May 21.

President Trump’s lawyers attached the documents as exhibits to a motion asking to suppress evidence seized by agents, arguing the raid was unconstitutional.

The warrant was cleared by a U.S. magistrate judge after agents said there was probable cause to believe sensitive materials were being kept at unauthorized places at the resort. Officials said the raid would likely uncover evidence of obstruction of justice.

Agents arrived at Mar-a-Lago at 8:59 a.m. on Aug. 8, 2022, and initiated the search at 10:33 a.m.. A summary of what transpired stated that FBI leaders coordinated with local Secret Service leaders and that Secret Service agents “facilitated entry onto the premises, provided escort and access to various locations within, and posted USSS personnel in locations where the FBI team conducted searches.”

In addition to 25 FBI employees from the bureau’s Miami office, the group of DOJ personnel included five officials from Washington and two DOJ lawyers.

The group took numerous photographs, including pictures in the bedroom of former First Lady Melania Trump and a “child’s bedroom suite,” according to picture logs that were released on Tuesday.

President Trump’s lawyers said in the motion that the search was “roving and highly inappropriate,” citing how it covered a gym, a kitchen, and the bedrooms where the pictures were taken. They said the warrant was too broad and authorized agents to seize virtually any document from Mar-a-Lago.

Government officials have acknowledged they improperly seized passports and some other materials.

Agents remained on the scene until 6:39 p.m. They flew the seized evidence to Washington the following day.

President Trump after the execution of the warrant was charged with mishandling of national defense information, concealing documents, and making false statements.
Deadly Force an Option

The documents included a statement on the use of deadly force, which quoted government policy in stating that “law enforcement officers of the Department of Justice (DOJ) may use deadly force only when necessary, that is, when the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.”

The FBI also brought a medic and paramedic along on the raid, according to the documents, and listed the nearest trauma center in case anyone was injured during the execution of the warrant.

Agents were equipped with standard issue weapons, ammunition, handcuffs, and badges, and brought medium and large bolt cutters.

There was no basis for the FBI to bring guns into Mar-a-Lago, according to President Trump’s lawyers.

“There were no threats and no risk to agents’ safety arising from their allegations relating to possession of documents at a premises already guarded by the Secret Service,” the lawyers said.

The lawyers also argued that an FBI agent omitted relevant information from the affidavit submitted to the judge as part of the request to authorize the warrant.

The agent, for instance, “failed to disclose that presidents are not required to obtain clearances and that sensitive briefings including classified information had been provided to President Trump at Mar-a-Lago and other residences before and during his presidency,” the lawyers said.

In a DOJ filing in response to the motion, government attorneys countered the arguments.

“Regardless of Trump’s authority during his presidency, he lacked authority to possess classified documents at Mar-a-Lago after it ended and he became a private citizen. Trump’s authority to access or possess classified documents during his presidency was both obvious and immaterial to the probable cause determination regarding the retention of the documents after his presidency,” they wrote in part.

The attorneys also said that while some FBI officials did suggest seeking the consent of former President Trump to search Mar-a-Lago before seeking a warrant, his “prior obfuscation and deception up to that point” meant there was “ample reason to avoid seeking Trump’s consent, which would simply invite more deception.”

All law enforcement agencies have standard template documents that they use when applying for a warrant. One of the paragraphs in that standard template is language that addresses the possible need to use deadly force. The standard language is an amalgamation of changes over time based on what judges want to see before approving a warrant. To that standard language they simply insert additional information that is specific to the scope of the particular warrant. After which they seek a judge’s signature.
