Maybe that state's DA's don't write such letters ("not going to prosecute" vs. "we are dropping charges already filed") and simply honor the agreements that have been made. Court said that it doesn't matter that it wasn't in writing. A deal is a deal.

True... if you can show a deal was in fact made, it is binding from my understanding.

If you can prove a deal was made on a handshake, the same result would happen... but it's hard to prove a handshake to seal a deal happened.
