Three years ago, a lady was murdered in the town of Truro which is near the outer tip of Cape Cod, Mass.
They never found her killer, but they have DNA due to the fact that she had sex (consentual or not, I don't know) just before she was killed.
Now, the town has decided to "help" the police efforts by making it mandatory for all male occupants of Truro to give a DNA sample. Swab the mucus from inside the mouth.
Many that knew her quickly volunteered. The men who don't want to, however, have been informed that they will be considered a suspect in this old crime.

What are your thoughts regarding this?

3 yrs ago... the Purp. is probably long gone and has killed others and or is probably already locked up elsewhere's in the country... now on a Constitutional Rights side of this... these folks/men should not have to be forced to do anything and I would push it to the extent of having them arrest me for it...My DNA is already recorded somewhere in the federal system because of being a member of the Armed Forces and it was required to be collected, at which I did not have a problem with giving up this freedom... without a signed consent they cannot pass any medical information on to anyone and doing so would be in violation of your civil rights through the laws enacted by HIPPA...

an old case police grasping at straws, I would tell them to arrest me and force the hand...

Hog,

On this topic, I agree. They'd have to arrest me and force me to give up a sample of my DNA. We've lost to many liberties as it is.

Why stop at ted kennedy do the whole freakin clan, they are nothing but a bunch of drug users, alcoholics, rapists, and murderers.

As for me if they want my mucus, they would have to pry it from my dead dry lips.

From the standpoint of effective policing, it just doesn't work. This used to be fairly common in England and in Europe, but the expenditure of time and effort is rarely rewarded. The perps just never seem to want to get their mouths swabbed.

The advent of DNA technology is to criminology what the wheel was to transportation. In California we just passed a ballot measure that requires all prison inmates to give a sample of their DNA to the state data base. One of the nicest things about this technology is that it sometimes allows for 'cold hits.' Say a kid is raped. A sperm sample is taken and fed into the data base. There have already been cases where positive matches were made, and prosecutions have occured. Otherwise the creep would have gotten away scott free. In the olden days, without an eye-witness, events like these were just a matter between a person and their maker. Now it's possible to actually nab the lowlifes based on irefutable evidence. Suddenly lying's even harder. Protecting people's unique DNA sequence from criminological investigation makes about as much sense as banning fingerprinting. Both help the good guys nail the bad guys.

CP, I agree with the Inmates having to give up their Constitutional Rights when Incarserated they lose all rights as the laws should be... but as U.S. Citizens and the first amendment protections there of unless convicted should we have to lose those rights...

I also agree the DNA and Scientific methods used and still being discovered are of Great deeds and improvements for many uses and years to come...

but in the case above... I as Stated would not give up my freedoms such as this unless forced to beyond my constitutional rights... this is plain and simple rights violations...

They would have to serve me with a warrant before I would comply

That being said. In the near future all new born babies will have DNA samples taken, if its not already being done, "in the interest of public safety" And to aid in identification should the child come up missing or the victim of foul play
This will be how they sell it to us.
Within a generation they(and we know who they are)will have a nationwide data bank of DNA and will use it in every unsolved case where DNA evidence is left behind at the scene of a crime.
Not just murder and rape
But any crime where the suspect bled ( ie:breaking thru a window to a house) spit or sweated at the scene

so be careful when you jaywalk while jogging and leave a sweat pool at the intersection

Is this the mark of the beast??????

P.S. I believe that they should have suspicion of guilt, reasonable cause, to ask for a DNA sample.
Invasion of privacy concerns.

I read on yahoo that all men who do not submit to the test will be "watched". What happened to the Fourth Amendment? Already our rights are being taken away and now this. Too much.

I agree with charlie and DMV!

What about this scenario though...
You commit the murder and are still hanging
around that town...because your obviously a dumbass...
anyway the cops want your DNA, you say no,
and they arrest you and take your DNA anyway,
now your caught...duh!
Get out of town dufass

This is such an abuse of civil rights that it seems odd that the media has not given this even more press.

On the Outer Cape, the Patriot Act has been offically "denounced" by many town boards. Yet, these same folks claim this is the "right thing to do".

It'll be intersting to see where this goes.

...the ACLU has been very vocal about fighting this issue. They've even gotten involved in this particular case.

But, as a lot of you have already said....F*ck the ACLU, them commie freaks! Who are they to get involved? God gave us DNA, so therefore the government deserves to have a record of it.

Sounds like RagingMark is on the money. Seems to me to be a HUGE violation of everyone's Fourth Amendment rights. There has got to be some pretty large probative cause to demand someone's DNA.

Talk about illegal search and seizure- I want my fluids back!
