USAhog,
did you read the article. I am sorry, but if I am standidng in my driveway, as one woman was, and got doused by tear gas, I would be suing as well, if I wasn't pushing up daisies, because I lost my temper and shot the jackbooted thug that doused me.
Here is what one woman testified.

"I was stopped by a gentleman on my left approaching me with a shotgun," said Riera, who lived across the street from the home where the boy had lived since shortly after he was rescued from a shipwreck on Thanksgiving Day 1999.

"She said a black-garbed agent wearing a mask ordered her to "stand back" or he would shoot, adding a word of profanity. She said she complied, but a second agent approached with a gas gun as she stood in her driveway and left her in a gray cloud of tear gas."

She was not anywhere, but her own property. If we are to allow this, in America, we are not upholding the constitution, and these guys, deserve to go down, with their superiors. I thought the only place this happened was other countries like Russia, or China.

Homebrew,
I'm all for all citizens rights, and to be protected, especially while your on your own property. That article just does not give enough information. It sounds like there were a lot of people standing out on the street when this happened!

"A total of 108 people sued over the raid, but U.S. District Judge K. Michael Moore limited the case to people who were not on the Gonzalez family property and were beyond police barricades".

Who knows if someone made a fast move, or threw something, and the tear gas was sent into the crowd and she just got a cloud of it.

Not enough information to make a decision either way.
