A few things that come with the new FDA scrutiny...some just unbelievable!!!!

Yesterday the Food and Drug Administration’s (FDA) ‘Deeming Rule’ went into effect. There are already reports of Tobacoonists across the country being FINED! What does this mean for our business and for you our customers?

A prohibition on free samples is effective August 8, 2016. You are not permitted to distribute free samples at fundraisers, charity events, in-store events, etc. The sampling ban also applies to legislator gifts. IPCPR's best practice: A transaction must take place. Keep a paper trail.
CIGAR DAN workaround.....WE will now charge .01 cent for all FREE CIGARS given to any Charity including our Cigars For the Troops. Hey if I send an invoice for .25 cents to Iraq and the recipient does'nt pay me....what can I say....I charged him!

Minimum age and identification requirements are effective August 8, 2016. Verify by means of photographic identification containing the bearer’s date of birth that your customer is 18 or over. You must card everyone under the age of 27. If your business is in a state that has a stricter age limit, the state requirement still applies. IPCPR's best practice: Card everyone, even regular customers. This is the one that people are getting busted on! Sorry but we have to ask to see ID unless you are an old fart like me! However we have contacted our REWARD CARD Vendor and are attempting to get Rewards Cards that will have your picture and your Birthdate on them!

As of August 8, you are no longer permitted to distribute free samples and must practice extreme diligence with age verification. The FDA will be closely monitoring retailers' compliance with the rule, so we strongly recommend that you follow our best practices. Provisions of the rule are being implemented incrementally. This is a tough one too! Ok at events when we give you FREE Cigars....They won't be FREE anymore! I'm gonna have to charge you .01 cents each! Damned I hope you don't get upset and take your business elsewhere!

As you can see we fully intend to abide by all the wonderful laws that Washington continues to impose on us! Think twice when you vote this year....If you want more of the same...You know who to vote for! If you want a chance that Washington gets off our asses, then like they say in Euchre....make hearts Trump!

We DON'T need to know who you are or if your here legally to participate in OUR elections....We don't care if your already dead......but please don't mind if we card you to purchase a F*CKING CIGAR!!!!!!

Isn't it ridiculous? It is not okay to require people to have an ID to vote, but by god don't let people get away with possibly smoking a cigar who are under 18. It is Evvvvilll!!!
What is even funnier is that people who join the military at 17 can't buy a cigar or a smoke due to "health risk" but can go die in some ****-hole country.

How ironic....or moronic I should say. Absolute joke...

Smoke on brothers and sisters!

Possibly an ignorant question - trades are exempt correct? Or shall we all send out a penny during our trades?

Just send a bill for $.01. And wait.

Personally I don't see how getting carded or being charged $.01 for the event specials instead of free is that big a deal. The other aspects of it are what bothers me. How they chose 2007 as the year for which cigars are to be passed through this new regulation process is beyond me and will be putting a lot of the cigars I smoke out of commission or beyond the price point in which I would want to pay (luckily I have been stocking up on these cigars since I heard the news of this new regulation). I do think there should be some sort of regulation which may put me in the minority here or in all cigar groups but how they are going about doing it is solely to gain tax revenue and not for the betterment of the cigar makers or smokers.

In my favorite shpo, it's common practice to card like crazy. I don't know about other states, but NY often send undercovers to tobacco shops to make sure they are complying with age requirements. That said, I can't see how anyone would necessarily know if someone was under 27 to card them.

It'll be a pain for reps to charge a nominal fee to give out samples tho shpo staff, but they will do it. Same will go for event specials ... instead of buy 3, get one free it'll be buy 3, get one for a penny.

The big problem with the FDA rules is that as it stands now, smaller manufacturers won't be able to eat the expense of getting their post-2007 product through the approval process. One existing line, with 7 vitolas, could cost $50k or more in FDA fees. That's probably not a big deal for General or Altadis, but a lot of small-batch or private-label stuff will go away.

This is no doubt why we've seen many smaller companies already sell out to the Big Dogs rather than simply go under....under the weight of the new FUDA rules n regs.
