Witness 9" in Trayvon Martin case claims George Zimmerman's family is racist.

WTF Judge, over?

Witness 9 did claim that Zimmerman "only likes black people who act like white people.'

Witness 9 told investigators that Zimmerman, who is about two years older than her, had sexually molested her from the age of six up until she was 16 years old.

Judges don't bring up charges, prosecutors do. The judge's role is to run the court room. In the Z case, the current judge will be taking himself off the case because of improper comments he made at Z's recent re-bail hearing.

At this point, I don't give any credibility to #9's allegation. Not saying it didn't happen. just saying that just because she alleged it doesn't make it true. There is so much blood in the water already, look for that to be investigated too in the coming months. At this point, I think it is best for Z to request his pre-trial motion to dismiss hearing. The longer he waits, the more crap could be brought forward.

It does have that BS ring, but I have been on a jury with some folks that would eat that up regardless of the judges instructions. One reason I get cranky (er) about jury duty dodgers. If they do dismiss this, I hope Florida is ready for some rioting, might be good to time it as a hurricane makes landfall.

Today's Zimmerman news included taped jail telephone conversations between Pastor Terry Jones (Quran burner and supporter of Westboro's protests at military funerals...). Zimmerman asked the Pastor to pray with him; told him that both he and the city of Sanford need to heal; and asked the Pastor not to protest in Sanford, but to come to the jail to pray with Z instead of protesting.

Now, I despise Pastor Jones, but something seems very wrong here if one looks at this from the perspective of legal evidence:

Florida Rule of Evidence 90.505- Privilege with respect to communications to clergy.

(1) For the purposes of this section:

(a) A member of the clergy is a priest, rabbi, practitioner of Christian Science, or minister of any religious organization or denomination usually referred to as a church, or an individual reasonably believed so to be by the person consulting him or her.

(b) A communication between a member of the clergy and a person is confidential if made privately for the purpose of seeking spiritual counsel and advice from the member of the clergy in the usual course of his or her practice or discipline and not intended for further disclosure except to other persons present in furtherance of the communication.

(2) A person has a privilege to refuse to disclose, and to prevent another from disclosing, a confidential communication by the person to a member of the clergy in his or her capacity as spiritual adviser.

(3) The privilege may be claimed by:

(a) The person.

(b) The guardian or conservator of a person.

(c) The personal representative of a deceased person.

(d) The member of the clergy, on behalf of the person. The member of the clergy's authority to do so is presumed in the absence of evidence to the contrary.

This Rule has to do with precluding evidence at trial. It is of no probative value whatsoever and isn't relevant to the charges. Z's attorney has asked the court to delay the state's release/publishing of each bit of "evidence", but could not get the matter heard in time. So, the state went ahead and started releasing crazy stuff like this anyway.

Not fair and not right- whether or not Z is guilty!
