There is a problem and I see where the Pentagon is coming from....

Award Purple Hearts and it was an act of war. You can't put the guy on trial for murder in that case. He is a POW that eventually will need to be released. He was just doing his duty.

I think that still leaves open the angle of shooting him as a spy wearing the US uniform but we would probably go more along the lines of trying to rehabilitate him.

War laws are tricky.
