THIS IS WHAT'S WRONG WITH "RED FLAG" LAWS 😠 First, This Marine Was The Victim of Road Rage. Then, He Was The Victim Of Red Flag Laws.

Imagine you are out running an errand with your wife and kids when you end up on the receiving end of a road rage incident. That’s what happened to my friend Aaron yesterday, and while nobody was hurt …it still didn’t end well.
Pay attention because this could certainly happen to you.

The story goes like this. Aaron, a Marine and his family were on their way to Lowes in Wichita, Kansas when they were cut off in traffic. Aaron honked his horn at the other motorist who in turn pulled into a driveway and allowed Aaron to pass.

The man then pulled in behind Aaron’s vehicle and followed them to the Lowes parking lot. Once Aaron and his family exited their vehicle the man confronted them, and Aaron began telling the man to leave.

Instead, the man continued to approach with his hands hidden from sight.

Fearing for the safety of his family, Aaron held a pistol at his side. It wasn’t until the man came around Aaron’s vehicle and saw the pistol that he backed away, threatening to call the police.

Keep in mind, the weapon was never pointed at anything other than the ground. As the man retreated, Aaron called the police and began gathering nearby witnesses to give statements to the officers who arrived on scene.

A reasonable person would think this story ends with both parties going their separate ways thankful it didn’t end differently, but that’s just not the case.

The police ended up confiscating Aaron’s legally owned firearm and stated he may be charged with aggravated assault.

It should be noted the other man stated he had a firearm as well.

Having had enough for the day, Aaron and his wife decided to forego the items he had come for and headed home. But just a few blocks up the road the same man was waiting, and began following them again.

Aaron called the police again, but the man continued on when Aaron stopped to meet the officers. Even after this, Aaron is still the one facing possible charges!

So now we have one man who lawfully defended his family and another who has instigated this situation. The man that defended his family is now disarmed by police and facing potential criminal charges. He then leaves the scene only to be followed again by the same man!

Before anyone starts talking about laws, Kansas is one of the few states that has constitutional carry. On top of it, they also have a stand your ground law. Simply put, law abiding citizens have every right to carry a firearm without a concealed carry permit, and also have no obligation to retreat if they feel threatened.

I’ll be the first to tell you that if you come at me and my family, retreating isn’t an option for me. State laws aside, let’s tackle this topic on a broader scale.

This situation raises a great cause for concern if you step back and look at it. The police obviously didn’t have enough probable cause to arrest Aaron, or they would have, and yet his legally owned firearm was still confiscated while he was allowed to leave.

What if the second encounter hadn’t gone the way it did? What if the second time the other man decided to put his own firearm to use murdering Aaron and his family since he now knew Aaron was disarmed by police?

This is a prime example of what happens when we remove due process. We are seeing this on a greater scale with the passage of red flag laws, where your firearms can be taken simply because someone makes a statement saying they’re scared of you.

Here in Texas he'd have been fine more than likely under those circumstances.

I drew a weapon on 4 individuals outside my hotel in Lubbock who were casing my vehicle.They refused to leave and two started towards me of which one had his hands in his pocket.They retreated to their vehicle and left when I cleared leather...…..abruptly I might add.I went to the hotel manager and told her what happened.She knew of these characters...…..We left for about 30 minutes.On return we saw the cops with the perps in the parking lot of the hotel next door,all 4 cuffed and sitting on the curb.I told the free officer what had happened.He asked me to step over near them and make a positive ID.As I stepped around the cruiser one of the perps said "that's the guy.....that's the mother **** er who pointed a gun at us".The cop never skipping a beat said "you're lucky to be alive dumbazz".3 of the 4 had warrants and the 4th they arrested for good measure.I got ID'd and ran...….gave a brief statement and went on my merry way.I love Texas

I thought a judge had to issue an order before the red flag law can be enforced?

In the situation posted No I do not feel the weapon should have been taken from Aaron. Second. I most likely would have went to jail if I was in Aarons shoes.

If I felt even remotely that my family was in harms way the other fellow more than likely would have not been able to call the law, much less speak. That is one of the few things I will not chance no matter what.

Sometimes I wonder with such because it would not be the first time I have ran across police officers that they themself do no know the law. To take away the man's weapon and send him on his way it very well could have turned out the other armed fellow could have killed Aaron and his family which was stupidity on the officers behalf I think.

Any grown man that follows a car into a parking lot with the intention of confrontation as above should be viewed as hostile and if it is me he is following he damn well better be scared.

I wonder if the possible charges are due to Aaron having the weapon un-holstered and somewhat at the ready (holding the weapon at the side) from the officers view point?

Either way using "Red Flag Laws" in such a situation to me is wrong but, that is just me.

IMO you always need to be the first to call it in. And ALWAYS call in if there's even a slight chance that you think someone felt threatened by the sight of your gun. CYA, By the way, I'm in Wichita, which Lowes? Just curious.

Troubling chain of events. Wrong on so many levels.

I made some calls to people that are better versed in those laws than I am and we're trying to understand what grounds they had to confiscate his pistol if he wasn't charged with anything. And if he WAS charged, he would have been wearing silver bracelets. He needs a lawyer. This wouldn't be the first time WPD screwed up by not knowing the law. FYI, you have nothing to loose by simply stating that "I do not concent to the search of my person or my vehicle or the seizure of my belongings."

Fred, from Connecticut, was visiting his friend Bubba in south Texas.
They decide to go out and do a little hunting.
While walking through the field, an illegal alien jumps out of the brush and starts running.
Bubba raises his rifle, takes aim, and shoots the guy dead.
Horrified, Fred says, "BUBBA . . . WHAT THE HELL ARE YOU DOING ?"
Bubba calmly replies, "Don't worry, Fred. It's not against the law to shoot illegals in Texas."
Fred says, "Ohhhhh . . . I didn't know that."
Later that night, Fred heads out to the local convenience store and picks up a six pack.
When he gets to his car, he puts the beer on the hood while he gets his keys out of his pocket.
Just then, an illegal runs past and snatches the beer off the hood and starts running down the road.
Fred pulls out his Glock and shoots the guy.
When the police arrive, Fred explains what happened and the officer says, "Okay sir . . . turn around and put your hands behind your back. You're under arrest."
"Wait a minute", Fred says. "I thought it was legal to shoot illegal aliens in Texas."
"Well sir, it IS . . . but you can't use bait !" 🤦

Standard FB c&p... Who knows if these people even exist. And even if they existed, it screams "That really irresponsible and hotheaded friend giving their account of why the cops took their gun away and it was totally unfair because they definitely didn't do anything wrong".

I don't see that Kansas actually has a "Red Flag Law" in place. Looks like it died in committee back in '08.

Sounds like this story isn't entirely accurate. However, it does illustrate the potential problems with this type of legislation. 🌫
