Especially from the Attorney Generals offices...

I just cought a bit of news on the Nursing Home deaths in N.O. 30+ deaths because these people were left in the home while workers and staff hauled ass... yep blame should be upon these individuals and charges made... But the AG's office said they were going to look into the matter.. and at the same time Administrative folks from the home said there was no plan of action to evaquate these people in an emergency? shouldn't/wouldn't it be the responsibility of one of these State Agency's to assign Inspectors to regulate what emergency plans would be? and if these plans were not met and or set in place prior to the emergency??

WTF the little guy at the bottom gets the broom handle??

from what I'm hearing on the news.. the bottom line is the AG's office is looking at filing charges against the Staff at the nursing home and closing the door on the issue? I think this should also be added into this "Investigation" as to what went wrong that Congress is talking about... if there wasn't an emergency evaquation plan in action prior too.. then some State Official's heads should roll as well?

I had a facility in St. Petersburg, FL so I know that we were mandated to have a disaster plan. The plan included written arrangements with another facility to accept our residents in the event of flooding (we were in a flood zone, the other facility was not).

The charge would be abandonment. Nursing personnel are not allowed to even leave their shift if a replacement isn't coming in. They will be reported to the licensing board and likely have their licensed stripped.

I don't know if it could result in a criminal charge however. I've never seen one proceed to that level.

I can understand that being charged to the Staff members of the home.. my question lie's with the Emergency reponse preperations for just such, and the statement made by the nursing home administrators.. of which this would also be at fault to them as well as State Agency's for not making sure something was in place?

By DOUG SIMPSON, Associated Press Writer

The husband-and-wife owners of a New Orleans-area nursing home where 34 people died in Hurricane Katrina's floodwaters were charged Tuesday with negligent homicide.

The case represents the first major prosecution to come out of the disaster in New Orleans.

The owners of St. Rita's Nursing Home in the town of Chalmette "were asked if they wanted to move (the patients). They did not. They were warned repeatedly that this storm was coming. In effect, their inaction resulted in the deaths of these patients," Louisiana Attorney General Charles Foti said.

Salvador A. Mangano and his wife, Mable, surrendered and were jailed on 34 counts of negligent homicide. Each count carries up to five years in prison.

The attorney general said he is also investigating the discovery of more than 40 corpses at flooded-out Memorial Medical Center, in New Orleans' Uptown section.

The Manganos had an evacuation plan as required under state law and a contract with an ambulance service to evacuate the patients, but they did not call the company, Foti said. They also turned down an offer from St. Bernard Parish officials who asked if the nursing home wanted help evacuating, he said.

Foti said the bodies have not all been identified and he was not sure how many of the victims were patients or staff.

Hi Russ.

If the above is true, the owners should never see the light of day again. I do not know the penalty for negligent homicide but if found guilty of all counts and sentenced to consecutive terms maybe that will come to pass.

Hog:

All I have in SC at this time is land. We haven't yet started building. We are technically out of the flood plain, but I can see if a big enough storm came through we could be in trouble. So yes, I will get flood insurance. The good news is that the part of Cherry Grove that lies between us and the ocean contains some older home that have never been storm damaged. Hopefully it will remain this way.

The relatives should also take some of the blame.

If I had family there, I would have picked them up & out of harms way.

Seems like family doesn't want to be "inconvenienced" any more.

Let others take care of your burden and then point the finger.

Last night O'Reilly interviewed a woman who lost her mother in that home.

She said she talked to the owners on Saturday and they had evacuation plans for all the residents. She also said something like 16 of her family members evacuated NO, and any of them could have picked her mom up but they were told by the owners the residents would be evacuated if needed.

Of course, we all know the owners were only charged because they're not caucasian, I'm sure Bush had something to do with the charges being brought, there's a paper trail somewhere...maybe even on the internet.

zoinks,

I cought that on O'Riely also...

Did you catch the other guy's interview following this womans? I cannot remember what his title was? but he was part of the Nursing Home association in NO area... he was basically defending these owners, discussing what had happened in a previous Hurricane a few years before where the Traffic was backed up and many elderly folks passed away because of the heat and traffic jams... So he felt this was the decission of the owners was a fair thought?? Hmmmmm... now I'd really like to see the Emergency plan for the Nursing Homes in the State of NO..

I saw that guy too, I thought he was head of licensing or regulation for the state or something like that. He pretty much said it wasn't the owner's fault at all.

If it's a problem that they get stuck in traffic for 12 hours and die on the bus (as he said occurred before) then the state needs to provide for a medical evacuation lane.

How do you keep that lane open? M1A1s can cruise pretty fast. Use two, the first one crushes anything in the way, the second one has a plow to push them out of the way.
