Democrats Promise To Save ‘Democracy’ By Destroying The Supreme Court



The plan to pack the Supreme Court is a more consequential attack on the constitutional order than January 6th.

It’s difficult to sit here and make substantive arguments against the Democrats’ Supreme Court “reform” proposal, since everyone knows it’s just a cynical ploy to delegitimize both the court and the Constitution.

Ask yourself this: would any Democrat support the president’s court-packing scheme if they believed Republicans would win both Houses and the presidency? Of course not. It’s Calvinball all the way down.

And it is a court packing scheme. An unconstitutional one. One imagines the term “court packing” hasn’t polled very well with the public, so Joe Biden — or whoever’s running the White House these days — signed off on a backdoor plan. An 18-year term limit for justices would, very conveniently, turn a 6-3 originalist majority into a 6-3 “living and breathing document” majority that would overturn many recent decisions, and rubber stamp a slew of federal abuses.

One might argue it’s all just an election gimmick, since the chances of the reform package passing are close to nil. That’s not the point. The left has normalized the notion that the Supreme Court is both illegitimate and corrupt if it fails to bend to the will of partisans.

After all, none of the left’s objections are grounded in anything resembling a legal argument. The entire case is centered around the specious idea that the court is failing because it does not adhere to the political vision of Democrats. They don’t even pretend to care about neutrality in law, much less the law itself. The contemporary leftist is a consequentialist with no limiting principles.

Speaking of authoritarians. Kamala Harris contends that packing the Supreme Court is necessary because “there is a clear crisis of confidence facing the Supreme Court.” Is there?

First off, we find ourselves here because of decades-long attacks on the institution. Democrats have made a mockery of confirmation hearings since the 1980s. After Barack Obama publicly castigated the Supreme Court for upholding the First Amendment, things really took off. Wealthy progressive activist groups began cooking up pretend scandals and laundering them through faux journalistic operations. The media can now affix the phrase “plagued by ethic scandals,” or some such nonsense, to every mention of the court. If there is any crisis of confidence, it’s because the left concocted one.

Even still, as Casey Mattox helpfully points out, Gallup finds that 30 percent of Americans have a “Great Deal/Quite a Lot” of confidence in the Supreme Court. The number has risen slightly in the past two years. Another 31 percent say they have “Some” confidence in SCOTUS.

So, let’s set aside that pesky Article 3 of the Constitution for a moment. If polling is the excuse for stripping the independence of a branch of government, why would we allow Congress, with its 9 percent confidence rating, to do it?

Justices already enforce a code of judicial conduct. There is zero evidence any of them have engaged in unethical behavior on the bench that personally benefited a third party, much less themselves. And there is no evidence justices have deviated from their long-held legal philosophies because they vacationed with a rich friend or any other reason.

It’s also worth remembering that Democrats invented a bunch of new standards to smear Clarence Thomas that they would never follow themselves. Most judicial committee members leading the charge to delegitimize the court have traded in on their position to enrich themselves, including ****** Durbin, Vietnam War fabulist Richard Blumenthal, conspiracy theorist Sheldon Whitehouse, and Peter Welch.

Come to think of it, maybe SCOTUS should be writing ethics rules for Congress.

Democrats want to institute their ethics code to create a system that allows partisans — armed with the newest garbage Politico or ProPublica churns out for its progressive funders — to slander justices in another congressional show trial and bogus investigations. Sorry, the Supreme Court is an equal branch of government. Chuck Schumer is free to threaten justices, but they still don’t answer to him.

Nor do they answer to Biden, whose family became wealthy peddling a shady influence racket. The presidency, incidentally, has a 26 percent confidence rating with Gallup. The media, deservingly, is near the bottom of the list. Americans, in fact, have more trust in the Supreme Court than they do state-run schools or unions or big business or banks or the criminal justice system.

“What is happening now is not normal, and it undermines the public’s confidence in the court’s decisions, including those impacting personal freedoms. We now stand in a breach,” Biden says.

The only “personal freedom” Democrats are concerned about is legalizing abortion on demand into the ninth month. Just say Dobbs, because I can’t think of a single individual liberty the contemporary left wants to safeguard or enhance.

The president is correct in noting that the court has abnormally upheld the Constitution in recent years. Even then, majority concurrences are quite diverse. And the notion that the textualists walk lock step more than the left is a complete fantasy, as the last session showed.

The president, by the way, has been in government since 1973. Two-thirds of the members of the Democrat-controlled Senate are now older than 70. Judiciary chair Durbin has been in Congress since 1982.

Anyway, the lifetime appointments for justices are meant to shield the high court from the vagaries and fleeting pressures of political debate. That is exactly what bothers the left the most: the Supreme Court doing its job. If we knew exactly when confirmation votes were going to take place, the process would degenerate into an even uglier partisan mess. That, again, is exactly what the anti-norm leftist desires.

Indeed, the Democrats’ plan to pack the Supreme Court, the last properly functioning institution in D.C., is an attack on the constitutional order, and its long-term consequences are far more corrosive than anything that happened on Jan. 6. It’s not even close, really.

WSJ's Evan Gershkovich & Ex-Marine Paul Whelan Freed By Russia In Major Prisoner Swap With US



In a massive overnight night development, Russia has released Wall Street Journal reporter Evan Gershkovich and former US Marine Paul Whelan in a prisoner swap, Bloomberg and others confirm.

Some sources are saying that as many as 20 and 30 political prisoners and journalists might be part of a multi-country exchange reportedly in progress, but what's certain is that Gershkovich and Whelan are currently on their way to freedom.

"The men, jailed in Russia on espionage charges they and the US deny, are en route to destinations outside of Russia," reports Bloomberg. "The US and its allies will return prisoners to Russia that they hold under the deal, the people said, asking for anonymity to discuss matters that aren’t yet public."

And The Moscow Times speculated overnight as rumors swirled of an impending major deal with Moscow, "Russia may be preparing to free between 20 and 30 political prisoners and journalists in an imminent exchange with the United States and Germany, a source familiar with the planning said, in what, if confirmed, would be the largest swap since the end of the Cold War." However, these latter details have yet to be confirmed. It is also as yet unclear who on the Russian side is being freed.

Only very recently, on July 19, a Yekaterinburg handed down a very significant 16-year prison sentence in Gershkovich's espionage case, after he had been behind bars since is March 2023 arrest.

Russian authorities claim he was spying for the CIA while investigating a major Russian defense company in Yekaterinburg, a city which lies east of the Ural Mountains.

It is widely believed that Russia was using the case as a bargaining chip all along, in order to free high level Russian detainees in the West, just like the prisoner swap involving Brittney Griner and Viktor Bout played out.

As for Marine veteran Paul Whelan, who was issued a 16-year sentence in 2020 on charges of espionage - which the US government condemned as false and unfair - his family had long complained that his case didn't get the attention from Washington that it deserved. But his fate appears to have suddenly and drastically changed for the better.

Evan Gershkovich: Wall Street Journal reporter arrested in March 2023, charged with espionage.
Paul Whelan: Marine veteran arrested in December 2018, sentenced to 16 years for espionage charges.
Alsu Kurmasheva: Russian-American radio journalist detained in June 2023 for allegedly spreading false information about the Russian army.

Other Prisoners Involved:

At least 12 political prisoners held in Russia are expected to be released to Germany.
Eight Russian nationals are to be returned to Russia, including some with suspected ties to Russian intelligence.
Vadim Krasikov, a convicted murderer serving a life sentence in Germany, is expected to be part of the swap.
Vladimir Kara-Murza, a Kremlin critic and Washington Post contributor, is expected to be flown to the U.S.

"The Administration’s cowardice in the face of terror is a national disgrace."

Republican Kentucky Senate Minority Leader Mitch McConnell condemned the Biden-Harris Administration for what he described as weakness in the face of America’s enemies.

“The plea deal with terrorists – including Khalid Sheik Mohammed, the mastermind of the 9/11 attacks that killed thousands of Americans – is a revolting abdication of the government’s responsibility to defend America and provide justice,” McConnell said, New York Post reported.

McConnell was not alone in his bitterness that three defendants allegedly involved in the Sept. 11 terrorist attacks have entered into a plea deal with the United States Department of Defense (DOD) after years of incarceration at Guantanamo Bay.

Nearly 3,000 people were killed, and many thousands more injured in the coordinated Islamist suicide attacks carried out by al-Qaeda on U.S. soil in 2001.

As Stephen Katte reports via The Epoch Times, according to a July 31 statement from the DOD, Susan Escallier, who is the Convening Authority for Military Commissions, has entered into pretrial agreements with Khalid Shaikh (Sheikh) Mohammad, Walid Muhammad Salih Mubarak Bin' Attash, and Mustafa Ahmed Adam al Hawsawi.

Mohammad, a Kuwaiti-Pakistani mechanical engineer, was the former head of al-Qaeda’s propaganda department and is accused of being the 911 mastermind. He allegedly presented the idea of hijacking planes and flying them into U.S. buildings to Osama bin Laden around 1996, and later helped train some of the hijackers.

Hawsawi has been accused of helping with financial and travel arrangements for the hijackers. Attash is accused of assisting with combat training for the terrorists.

Specific terms and conditions of the pretrial agreements have not been made publicly available by the DOD.

The three defendants, along with two others, Ali Abdul Aziz Ali and Ramzi Bin al Shibh, were first jointly charged and arraigned in June 2008. They were charged and prosecuted again in May 2012.

Aziz Ali and al Shibh did not enter into the plea deal. Last September, a military judge ruled that al Shibh was too mentally incompetent to stand trial.

ACLU Says Death Penalty Off the Table

The American Civil Liberties Union (ACLU), a non-profit civil rights advocacy group, says Mohammed is their client, and the deal involved the defendants agreeing to plead guilty in exchange for life imprisonment instead of the death penalty.

Anthony D. Romero, executive director of the ACLU, said in a July 31 statement that this deal was the “right call” for everybody involved, especially after “nearly two decades of litigation.”

“This plea agreement further underscores the fact that the death penalty is out of step with the fundamental values of our democratic system. It is inhumane, inequitable, and unjust,” he said.

“We urge the U.S. government to also quickly relocate the men cleared for transfer, and finally end all indefinite detentions and unfair trials at Guantánamo.”

According to Romero, “closing the chapter on these cases with a plea agreement will also provide a measure of transparency and justice for 9/11 family members.”

That's not how the families of the victims see this plea deal...

In a media statement about the plea agreement, Brett Eagleson, president of 9/11 Justice, a grassroots movement made up of survivors of the terrorist attacks and family members of those lost, said the group was “deeply troubled by these plea deals.”

“These plea deals should not perpetuate a system of closed-door agreements, where crucial information is hidden without giving the families of the victims the chance to learn the full truth,” he said.

Eagleson said the 9/11 Justice group wants more access “to these individuals for information” to provide closure for all those affected by the terrorist attacks.

Republican New York Rep. Mike Lawler described the plea deals as a slap in the face to the families and survivors of 9/11.

“Disgusting that these terrorist scumbags are being let off without a trial. 9/11 victims, their families, and our heroic first responders deserve true justice!” he posted on Twitter.

The White House clarified President Joe Biden was informed of the plea agreement only on Wednesday and had no role in the process, which is being handled through the military justice system, according to the New York Post.

Former President Donald Trump’s administration previously rejected any plea bargains with the suspected terrorists held at Guantanamo.

This whole scenario makes me sick. I agree with what is written in the post. At the same time, I’m sickened at how America has managed this “program”. I know it is complicated and a thorny issue to say the least. However, the way it was handled was not in keeping with the values of our country. If we didn’t have offenses that were satisfactory to charge them with then they should not have been taken prisoner. Battlefield justice would have sufficed. We made a lot of mistakes after 9/11 and this was one of the big ones. This is just my opinion, as usual. I understand that others will disagree and see the scenario differently than I.

One option would have been to simply shoot them when they were captured. We the public have no idea if they any of them have provided any meaningful intelligence. But by executing them immediately we can be certain none would have been gained.

Since they were not executed and instead brought to a US military installation then they effectively enter the US legal system. As such, as distasteful as it may seem, we are a nation of laws so if we start picking and choosing who is and who isn’t entitled to the minimum protections of the law then we devolve into the very society we find so disgusting.

As far as the plea deal itself I wonder if it’s really such a bad thing. Rest assured they will all be sent to ADX Florence to live out the rest of their lives as did Ted Kazinsky which was virtually forgotten.

Or we could continue on the same path we were on. Many more years would go by wrangling in court before a trial even took place. Assuming they were found guilty which by the way wasn’t guaranteed. There would be decades of appeals. Each time a hearing came up they would once again they would command top billing in world wide media. There is a better than average chance one or more would die in prison before any death sentence was carried out.

As it is now they may stay in the news cycle a day or too. More depending on how much outrage is expressed over the plea deal. Then they will cease to be relevant. More than likely the next time any of their names are mentioned will be when the start dying off in prison.

So I ask, when all things are considered did we really get a raw deal? As a veteran I tend to think everything will work out just fine.

But the octogenarian president – who abruptly ended his 2024 re-election campaign and dropped out of the race for the White House on July 21 – also created newfound concerns about his health upon welcoming the Russian captives back home this week.

According to Daily Mail, witnesses present at Joint Base Andrews in Maryland on Thursday night said Biden “stared blankly” and “looked off into the distance” while Vice President Kamala Harris welcomed Kurmasheva, Gershkovich, Whelan and Kara-Murza off the plane from Turkey.

He was also said to have only moved once during the post-midnight event – to scratch his head with what one onlooker described as a “vacant appearance.”

One person took to X to criticize President Biden for his appearance at Joint Base Andrews, saying: “This dude is not there.”

As we previously highlighted, the end for Biden came after Pelosi suddenly changed her tune, going from defending him one day to saying that it was time to question his mental acuity the next.

During the CBS interview Pelosi called Biden “Such a consequential president of the United States, a Mount Rushmore kind of president of the United States.”

Stahl seemed awestruck at this preposterous suggestion and laughed at Pelosi.

“Are you really saying that he belongs up there on Mount Rushmore? Lincoln and Joe Biden?” she asked.

“You’ve got Teddy Roosevelt up there!” replied Pelosi. adding “You can add Biden.”

Report Finds Biden-Harris Released 99 Illegal Aliens On FBI Terror Watchlist Into American Communities



A new interim staff report from the House Judiciary Committee and Subcommittee on Immigration Integrity, Security, and Enforcement, published on Monday, highlights how the Biden administration, with 'Border Czar' VP Kamala Harris, facilitated the greatest illegal alien invasion ever on the United States.

The report titled "Terror At Our Door: How The Biden-Harris Administration's Open-Borders Policies Undermine National Security And Endanger Americans" revealed that the failed southern border policies of President Joe Biden and VP Kamala Harris have flooded the nation with more than 5.4 million illegal aliens. Additionally, at least 1.9 million known "gotaways" also entered, bringing the total to 7.3 million illegal entries.

Fox News' Bill Melugin, who also reviewed the report, said the border data that dates back between 2021-23 shows "at least 99 illegal aliens on the FBI terror watchlist were released into the US after being arrested by Border Patrol at the southern border, and another 34 watchlisted aliens are still in DHS custody."

"With the border in chaos under the Biden-Harris Administration, the terrorist threat to the homeland has skyrocketed. This border insecurity has been the Administration's choice, and it is a mistake," the report stated.

The report noted that 375 illegal aliens on the US Gov'ts terrorist watchlist have been apprehended by Border Patrol agents under Biden's first term with VP Harris as Border Czar.

The report continued, "That is a more than 3,000 percent increase of watchlisted alien encounters compared to all four years of the Trump Administration."

At the end of last month, leftist MSM spent days in an all-out propaganda media blitz to convince voters that VP Harris was never border Czar - that's because the nation killing open southern borders pushed by Biden & Harris is such a disastrous topic during the election cycle.
