The best is not putting yourself in this position in the first place, but, if one were to use bad judgment, and get caught in this predicament.

I recommend, get out of car and sit immediately on the road, or curb, refuse to speak or do anything, you are on video, refuse any tests. Do not give them any evidence to use against you later.

See a good lawyer, after.

General litmus test to decide. Disclaimer: these pronouns are simply for use of grammatical determination, and do not take into account any preference for said pronouns

If you can replace who/whom with he/she, you should probably use who.

If it sounds better to replace who/whom with him/her, whom is probably the correct call
