It's a Constitutional issue, there are no enumerated powers in the Constitution to authorize congress to legislate anything to do with healthcare, abortions or medical procedures of any kind. Not even close, At best these issues could fall to the states unless their state constitutions also do not authorize their legislatures to legislate the same.
