So many things wrong with this scenario. For someone to be held so long without the opportunity to post bail is ridiculous. However, the 8th amendment only prescribes that bail not be unreasonable, yet it's mum on the actual right to post bail.

Many times a Grand Jury has been called a DA's dog and pony show. In theory the Grand Jury is independent of the DA's office in that they have the power to conduct their own investigation. In reality, the truth is mostly quite the opposite. Generally, the a Grand Jury only reviews evidence presented by the DA.

It doesn't say so, but I apparently she had a warrant issued for the indictment between the time she allegedly sold the Xanax (which apparently she did not since the DA dropped the charges) and the time she was stooped for the traffic violation otherwise she probably would not have been booked for a traffic charge then held on a drug charge.

Was she denied due process? Very good question. It would seem that this is as good of a case as any to work it's way to the SCOTUS from them to decide whether or not the failure to set bail within a certain amount of time would be considered an example of excessive bail. Though many states require bail hearings within a certain time period obviously the 'Sip does not.

In any case, it would seem she was denied due process. The very evidence that was used to indict her was misrepresented to the Grand Jury. If nothing else it would seem she was the victim of MS Code § 97-7-35 which defines false swearing.

Somehow you crack me up with whatever you call that style of humor.

Don't fret over visiting the Sip. I'm well connected and I've got your back. Just make sure 8 speaks at a minimum. We don't need to draw attention to that horrible Yankee accent.

Mattie I'm glad you know I'm just jackin around and mean no harm.

I thought this was an interesting read and a chance to pick on you and the sipp at the same time. But as it says it's really an issue in several states.

I will always side with the state if for any other reason to keep federal encroachment at bay. The less centrally managed we are, the better.

did you read the story and still make that statement? there is literally no better argument for the need to centrally manage some things than this story... would you be willing to do a 90 day stint in prison for something you didn't do just to preserve a state's ability to violate someone's constitutional rights through a loophole?

I know a guy who spent a year in jail.
For eating ice cream.
In Oregon.
On a sunday.

But he should have known better.
So there's that.

Are you kidding me? MACS has the New England accent. Mine's more Southern Canada meets Iowa.

Mattie should tell the story of the job they did one some dude from New Jersey with the help of Mississippi law enforcement. Cue the chills running.

Hahahhaaa. Yeah that was Mando. I still think he hates me for that. Sorry Mando

I honestly don't know which accent would be worse. Either way, y'all would stick out.

Of course I recognize everyone up your way would think I sound like a moron. Based on the accent, not content.

The 3 month minimum holding period was written into Obama Care. It's a privilege provided to everyone.

We tried that but Jackson got burned to the ground and Vicksburg sieged and starved out. Had that little battle in Gettysburg not been going on the same time more folks might know about it.

My great-great something or other got a switching from a Union soldier, The dayum Yankee killed the family pet chicken (yeah, we're rednecks) and Great-grandpa shot the yankee in the buttocks with a slingshot.

But 96 days in jail without bail/trial makes be proud to be FROM there. At least most my vices aren't on their way to being illegal there as they are in Kalifornia!

They don't have to be. You can be jailed for nothing.
