If you answer your door with gun-in-hand and the door-to-door canvaser for the Cancer Fund becomes frightened, has a heart and dies, you may be charged with negligent homicide. You may only answer the door, armed, if there is a situation of imminent danger, where you fear for your safety. The burden of proof does not lie with the person who knocks at the door, irrespective of the number of signs you have posted. You have the right to charge them with misdemeanor trespass, but that's it!

untrue, if I have a gun in my hand or in a external (visible) holster and im in my house inside my doorway, it is legal, im in my house, only by me walking outside could one have a case, or pointing a gun at someone.

I have done the research. I know the laws in my town.

I just called the local police station, and asked the following:

Can one wear a gun in a external holster (visible) or have a gun in my hand pointed at a safe direction and answer my door while standing inside my own house?

I was placed on hold then a policeman came on and told me yes you can answer the door like that. But threatening one with a firearm is against the law. (by saying IM GOING TO SHOOT YOU) or pointing a gun) would be considered threatening.


So there it’s settled.

Sorry 65gtoman, you are confusing what you wish to be true with the law. Of course, you may walk around your home with a holstered revolver. It is your domicile and you are within your rights. You may answer the door, wearing the holstered weapon, but if at any time you give even the slightest indication that you intend to withdraw the weapon, and there is no imminent threat to your safety, you are subject to assault charges.

Let's say an obnoxious pot and pan salesman comes to your door. You answer the door, wearing a holstered weapon. You tell the peddler that you don't want to buy anything and that your land and home are posted, "no solicitors." He continues his sales pitch, as though he didn't hear a word of what you said. You tell him to stop and leave. He continues his sales pitch. You reach for your gun. You can be charged with misdemeanor assault with a deadly weapon. You had no imminent threat to your person or possessions. Your recourse was solely to call the police and have the man removed. It sounds unfair, and may well be so, but it's the law.

OR HAVE A GUN IN MY HAND POINTED AT A SAFE DIRECTION. That was what I asked the police.. So ill take their word before yours.


you do not need to have it holstered, but true if it was in a holster then you pulled it out, maybe, but if it wasn’t in a holster to start with then its ok, that’s what I asked the police, read the post again. Anyways no point in saying anymore about this, I got proof and I guess you don’t want to see it. Many farmers only have shotguns and cannot holster their firearm so they point it into a safe direction.

On the contrary, I'd really like to see the citation and case law of the local ordinance. Please post it with city ordinance reference numbers, so I may read it.

Your "discussion" with a policeman would have no bearing in an evidentiary hearing on an assault allegation.

ANYWAYS, I can tell you this, they haven’t been back to my house and its been many years now. Also due to them knocking on the door the last time I never did find out if Higgins was robin masters after all!, and for that I will never forgive them!
