That's far from the real reason: Insurance lobby money rules the state legislature.
No statutory penalties for an auto insurer failing to act in good faith. So, their reply to everything is just... sue us. Their lawyers cheat every chance they think they can get away with. Judges punish them harshly. Then, when the cases go to court and they get creamed because of their lawyers' behavior, those are the only cases they complain to the legislature about.
Worse, the legislature won't listen to the consequences of weak auto insurance laws for real people. The laws could be easily revised, but wouldn't be as profitable for the insurers- so it stays this way.
And, we don't enact appropriate, mandatory, auto insurance coverage with sufficient penalties for not having it.
