Trump can nominate all he wants,but the Senate must confirm, so now the fight moves to the mid-term elections to see if the Reps can keep a majority or add to it or lose it.

as for Kennedy, he was conservative at his core, but sided on several social issues with Dems, revealing an independent libertarian streak...you can bet that whomever is nominated will be vetted thoroughly to ensure a similar independent streak is absent...

We should demand straight up or down votes regardless of President and start now. Forget the Biden or McConnell rule (which were also apples and oranges but thats inconvenient). Straight up 60% vote required every time. No delay.

Dropping it to 50 and using the gamesmanship we've see from both parties hurts the country. This should be bipartisan agreement, with an emphasis on the constitution rather than winning or getting the guy that will do what we want.

To some this is a game.

Simply regarding Justice Kennedy, the man: he's long been regarded as a swing vote (sometimes benefitting the left, sometimes the right.)
As someone here said: an independent and honorable thinker/individual.

I agree. The Supreme Court really should have zero political affiliation. Also I think it should be a balance of conservatives, liberals, and moderates.

Another sad thing is that even though a majority of Americans did not vote for this President, the majority must live with his decisions, for decades to come.

Take for example, the Citizen's United decision...Kennedy's gift to the business class...the new guy will be just like that, prolly moreso...
